Laporan Penelitian_IMPLEMENTASI PUTUSAN MAHKAMAH KONSTITUSI No.97/PUU-XIV/2016 PADA MASYARAKAT ADAT KARUHUN URANG DI CIGUGUR

Abstract

The article from this research focuses on the implementation of Constitutional Court Decision No.97 / PUU-XIV / 2016 in the AKUR community at the Kuningan Cigugur. The issue raised was the implementation of the Court's decision by the Government and the Kuningan District Government, and the suitability of the implementation of the decision. The study was conducted using a socio-legal research approach, with primary and secondary data collection, and analyzed descriptively and analytically prescriptively. The results showed: first, the government through the Ministry of Home Affairs and the Government of Kuningan Regency through the Department of Population and Civil Registry formally implemented the Decision of the Constitutional Court No.97 / PUU-XIV / 2016 by issuing KK and KTP-el with the religious column format trust column; secondly, the implementation of the government in implementing the Constitutional Court Decision No. 97 / PUU-XIV / 2016 has not been in accordance with the actual intent of the decision, which substantially interpreted beliefs including religion. Government actions are theoretically influenced by the world religious paradigm. This implementation needs to be followed by giving the opportunity for believers to join the recruitment of CPNS, TNI and Polri.
