Abstract

Films are part of cinematographic works that are protected by copyright law. Film is a cultural art work which serves as social institution and mass communication media that made with or without sound and can be presented. Before screening, cinema warns that the audience ware prohibited from recording the film, yet there were still many audience who recorded and disseminated film pieces through Instagram, a social media. Disseminating film pieces in theaters through Instagram means that the user did not appreciate someone's copyright rights. Based on this, the thesis will examine juridically about recording and disseminating film pieces through Instagram and law enforcement on recording and disseminating film pieces in theaters through Instagram. This study was compiled using normative juridical research methods, namely research that is based on the application of legal principles and principles to positive legal norms or regulations. This research examines library materials or secondary data such as laws, books, journals, and works from legal circles. The results showed that recording and dissemination of film pieces through Instagram, especially through Instagram Stories feature, is not an act of piracy since it do not cause a broad impact, but if the dissemination was considered as a copyright violation, law enforcement could be done through take down mechanism. closure of content and / or access rights, settlement of disputes through alternative dispute resolution or ADR, and civil and public lawsuits. The need for handling to overcome the dissemination of film pieces through Instagram social media, all parties must cooperate and do an active role in supervising and handling it, so that the creators, especially film, can further develop their work and the community can enjoy the work well and not harm each other . There needs to be a commitment from the government, law enforcement, and the role of the creator of the film to follow up on all forms of actions that have potential harm.
