Abstract

The rights of children today, especially regarding the protection of children in the juvenile criminal justice system has not been quite able to provide better conditions in the sense of getting rid of the bad condition of the child. In regard to the protection of some things and need attention, namely, shelter, protected parties feel secure in the protection. Interests and fundamental rights guaranteed and not harmed, even cultivated developed, so as to achieve growth mentally, physically, and socially maximum. The judicial process cause adverse psychological effects for children. Based on these conditions, it is necessary restorative justice as a form of prevention delinquency more attention to the special needs of children, and in an effort to achieve a restorative justice. The approach of method that used is a socio-legal studies, as well as historical and comparative approach. Types of data which used are secondary data and primary data. Secondary data were obtained by literature studies and documentary studies. The primary data were obtained by interview. Data Analysis which applied in this research is the data analysis of that is quantitative and qualitative. The result of study shows, it has legal and cultural characteristics, moral values, religions capable of solving problems with consideration, and their resolution mechanisms are in accordance with customary law processes applicable based on sociological considerations, in Medan, Denpasar and Surakarta.
