“RESTORATIVE JUSTICE” SEBAGAI ALTERNATIF PENYELESAIAN PERKARA ANAK DELINKUEN

Abstract

Anak dalam tumbuh kembangnya dapat melakukan tindakan menyimpang yang disebut sebagai perilaku delinkuen. Perilaku delinkuen berhubungan erat dengan tindak kriminal, yang mengakibatkan anak harus berhadapan dengan hukum. Permasalahan tersebut tentunya menyertakan proses hukum, dimana muara praktek penegakkan hukum kerap kali menempatkan mereka sebagai narapidana di dalam penjara. Anak yang berhadapan dengan hukum itu terdiri dari anak sebagai pelaku, anak sebagai korban, dan anak sebagai saksi. Dengan mengacu pada penyelesaian yang didasarkan pada prinsip kepentingan terbaik bagi anak, untuk itu diperlukan suatu alternatif penyelesaian perkara anak delinkuen melalui model keadilan restoratif. Penulisan ini menggunakan metode penelitian yuridis normatif dengan melakukan studi kepustakan dan dokumenter terhadap sumber tertulis yang sudah tersedia. Penulisan ini membahas tentang ide dasar rostorartive justice, formulasi restorative justice dalam UU Nomor 3 Tahun 1997 dan formulasi restorative justice dalam UU yang akan datang. Model restorative justice merupakan upaya musyawarah pemulihan dengan melibatkan korban dan pelaku beserta keluarga masing-masing, yang diharapkan dapat menghasilkan putusan yang tidak bersifat punitif, namun tetap mengedepankan kepentingan dan tanggung jawab dari anak sebagai pelaku tindak pidana, korban dan masyarakat itu sendiri yang pada akhirnya diharapkan dapat menghindarkan anak delinkuen dari catatan hitam proses peradilan karena pernah terlibat dengan proses hukum. UU Nomor 3 Tahun 1997 tidak mengatur mengenai restorative justice, model pemidanaannya masih mengacu pada model pembinaan individual. Sedangkan dalam rancangan masa datang sudah ada formulasi mengenai restorative justice. Penyelesaian dengan model restorative justice diharapkan dapat berjalan dengan baik, untuk itu diharapkan adanya persamaan persepsi diantara aparat penegak hukum dalam menyelesaikan perkara anak delinkuen dengan alternatif penyelesaian perkara anak delinkuen melalui penerapan ide restorative justice.
