MEMBANGUN MODEL ALTERNATIF UNTUK INTEGRALISASI PENYIDIKAN TINDAK PIDANA KORUPSI DI INDONESIA

Abstract

Membangun Model Alternatif Untuk Integralisasi Penyidikan Tipikor di Indonesia penting untuk dilaksanakan mengingat penyidikan Tipikor yang ada saat ini ditangani oleh lembaga penyidikan justru memunculkan kendala yuridis yang berakibat tidak optimalnya hasil yang dicapai, serta akan menyebabkan terhambatnya proses penegakan hukum Tipikor secara menyeluruh. Dari latar belakang tersebut timbul permasalahan 1): Apakah penyidikan Tipikor yang dilakukan oleh penyidik Kepolisian, penyidik Kejaksaan maupun penyidik KPK sudah integral, 2) Kendala-kendala yuridis apakah yang menyebabkan terjadinya ketidakintegralan dalam penyidikan Tipikor tersebut 3) Bagaimanakah model alternatif untuk integralisasi penyidikan Tipikor di Indonesia. Metode dalam disertasi ini menggunakan paradigma hukum Normative Fiosofis dengan pendekatan asas-asas hukum (rechtsbeginselen), sistematika hukum dan pendekatan sinkronisasi hukum dengan spesifikasi penelitian yang dipergunakan bersifat preskriptif dan evaluatif, dengan menggunakan analisis normatif kualitatif dengan pola pikir deduktif. Hasil studi ini menghasilkan simpulan : (1) Penyidikan Tipikor yang dilakukan oleh penyidik Kepolisian, penyidik Kejaksaan maupun penyidik KPK belum integral, disebabkan: a.undang-undang yang mengatur masing-masing lembaga penyidikan terpisah-pisah.b.Terkotak-kotaknya lembaga penyidikan tipikor menciptakan kecenderungan instansi sentries/fragmentasi c. Belum ada keintegralan dan keselarasan ide-ide, gagasan-gagasan, nilai-nilai, norma-norma dan peraturan yang menjadi landasan kode etik profesi.(2). Kendala-kendala yuridis yang menyebabkan terjadinya ketidakintegralan dalam penyidikan tipikor tersebut adalah a.Adanya multiplikasi lembaga penyidikan tipikor yang berpotensi menimbulkan egoisme sektoral dalam penyerahan perkara dari penyidik pada jaksa penuntut umum..b. Belum adanya formulasi peraturan perundangan yang integral dalam penyidikan tipikor yang dapat mengeleminir munculnya egoisme sektoral.(3). Model alternatif integralisasi penyidikan Tipikor dalam sistem peradilan pidana Indonesia a. Model Koordinatif, pada model ini lembaga penyidik merupakan gabungan dari penyidik kepolisian dan penyidik kejaksaan dengan KPK sebagai koordinator. Lembaga ini bertanggungjawab pada Mahkamah Agung b. Model Kolegial, pada model ini penyidikan dilakukan oleh suatu badan yang disebut sebagai badan penyidikan. yang anggotanya terdiri dari penyidik Kepolisian, Penyidik Kejaksaan dan Penyidik KPK dan dipimpin oleh kepemimpinan yang bersifat kolegial yang terdiri dari unsur Kepolisian, Kejaksaan dan KPK, badan ini bertanggungjawab pada Mahkamah Agung. Implikasi disertasi ini adalah perlu adanya keintegralan pola pikir, perlu adanya lembaga penyelidik bersama,.perlu adanya lembaga penyidik bersama antara Kepolisian, Kejaksaan dan KPK,dan. perlu komitmen pemerintah dalam usaha pemberantasan korupsi dengan mengoptimalkan seluruh potensi penegak hukum yang ada. Kata Kunci : membangun, alternatif, Integralisasi penyidikan. Developing the Alternative of Integral Corruption Investigation Model in Indonesia is important to be executed, considering the current corruption investigation which is executed by the investigation institution is showing the juridical signs that the output will not be optimal, this condition, however may delay the entire process of law enforcement towards corruption. The discussions based on the background are 1): Whether the Corruption investigation which is executed by the Police, attorney or KPK is integral or not, 2) What are the juridical obstacles that caused the unintegrated corruption investigation 3) How does the Integral Corruption Investigation Model as the alternative of the corruption investigation of in Indonesia. This dissertation employed the method of Philosophical Normative Paradigm and the Legal Principle Approach (rechtsbeginselen), legal systematic and the legal synchronization approach with a prescriptive and evaluative research specification, and qualitative normative analyzes with deductive mindset. The conclusions are: (1) 1. The corruption investigation executed by the Police, Attorneys or even by the KPK is not integrated yet, it happens because of: a. the regulations which constitute each institution are different. b. the fragmented-corruption investigations creates institution-centers mind set c. The integrality and harmonization of ideas, values, norms and regulation as the basis of the profession code of conduct does not exist. (2). the juridical obstacles which caused the unintegrated corruption investigation are a. multiplication of the corruption investigation institution that caused sectoral egoism in the process of case delegation from the investigators to the attorney. b. The integral regulation formulation for the investigation process to eliminate the sectoral egoism. (3). The Alternative Model of Integrated - Corruption Investigation in Indonesia a. Coordinative Model, the investigators is a composite of a combination of the police and attorney with the KPK as the coordinator. This institution in the future would be responsible to the Supreme Court. b. Collegial Model, in this model the investigation is executed by an institution which is called as Investigation Institution, the members are the Police, attorney and KPK and will be lead by a collegiate - leader from the police, attorney and KPK and would be responsible to the Supreme Court. The implication of this dissertation is that the integrated mind set, integrated investigation institution between the Police, attorney and KPK and also the government commitment in eradicating the corruption by optimizing the entire law enforcer’s goods is necessary.
