Abstract

Legal basis of industrial relations perspective of justice for workers of private companies in the context of the welfare state in Indonesia is article 27 paragraph 2 and Article 28d paragraph 2 UUD NRI 1945. Condition of the global crisis in the capitalist employment relationship is difficult to make justice found, because the employment relationship is based on different interests between employers and workers. Different factors that interfere with the interests of the fabric gives the effect of a harmonious working relationship between the parties, in addition to workers are helpless because the protection of workers is not implemented by the businessmen, entrepreneurs consider the working relationship oriented interests profit maximization, whereas the government's perception of employment potential conflict. Differing perceptions that encourage writers to make a critical reflection on injustice. Factually juxtaposed relationship the implementation of the welfare state labor relations in Indonesia does not reflect justice. The study questioned how the working relationships with the perspective of justice. empowerment is an instrument which is offered as material for reconstructing the working relationship. This research provides critical input for those who are in employment zone. Qualitative research methods using the paradigm of constructivism as a basis for research. To search the data using a phenomenological hermeunetic intended to collect, reduce and verification and present the data. progressive legal theory and the theory of empowerment is micro theories used to explain the phenomenon of research findings, while in analyzing the macro theory using the legal system theory and the theory of public policy. The end goal is to study the reconstruction of the empowerment of the working relationship. conclusions from this study (1) labor relations in private companies away from the values of justice (2) working relationship with the liberal capitalist model results are powerless workers, (3) offered a new concept in labor relations empower workers in private firms to use legal prismatic and legal pluralism.
