Abstract

ABSTRAK JUDUL : PERANAN PPAT DALAM PELAKSANAAN PENSERTIPIKATAN TANAH HAK MILIK DI KABUPATEN JEPARA Penelitian ini bertujuan untuk: (1) mendeskripsikan peran PPAT dalam pelaksanaan pensertipikatan tanah hak milik di Kabupaten Jepara; (2) mendeskripsikan faktor-faktor yang menjadi penghambat bagi PPAT dalam melaksanakan pensertipikatan tanah hak milik di Kabupaten Jepara; dan (3) mengkaji upaya PPAT dalam mengatasi faktor penghambat pelaksanaan pensertipikatan tanah hak milik di Kabupaten Jepara tersebut. Penelitian ini menggunakan pendekatan yuridis empiris, bersifat deskriptif analitis. Peneliti bermaksud menggambarkan fenomena yang menjadi pokok permasalahan dan akan mengekspresikan berbagai aspek yang terkait sebagai upaya pengembangan hukum pensertipikatan tanah, PPAT, dan bidang yang berkaitan dengan pensertipikatan tanah khususnya di Kabupaten Jepara. Teknik pengumpulan data disesuaikan dengan jenisnya, yakni: (1) data primer dikumpulkan melalui wawancara, dan (2) data sekunder dikumpulkan melalui studi pustaka. Adapun pengolahan data digunakan metode trianggulasi (trianggulation), pengecekan sejawat, dan referensi yang memadai. Analisis data pada penelitian ini dilakukan secara kualitatif yaitu data yang diperoleh disusun secara sistematis kemudian dianalisis secara kualitatif untuk menjelaskan masalah yang diteliti. Penelitian ini dapat disimpulkan (1) PPAT sangat berperan dalam memberikan kepastian dan perlindungan hukum dalam Pensertipikatan Tanah Hak Milik, tertib administrasi serta berpegang teguh pada Peraturan Pemerintah No. 24 Tahun 1997 khususnya Pasal 6 dan 42, Peraturan Pemerintah No. 37 Tahun 1998, maupun Peraturan Kepala BPN Nomor 1 Tahun 2006; (2) PPAT menghadapi beberapa kendala, yakni: (a) Surat-surat tanah tidak lengkap; (b) Saksi yang menguatkan batas-batas tanah dalam menentukan obyek hak milik tidak ada; (c) Nilai Jual Obyek Pajak (NJOP) tidak jelas; (3) Sebagai upaya mengatasi faktor-faktor yang menjadi kendala dalam Pensertipikatan Tanah Hak Milik, PPAT mengembalikan berkas untuk dilengkapi. Berdasarkan kesimpulan di atas, disarankan: (1) PPAT tetap konsisten melaksanakan tugas sesuai dengan kewenangan dan peraturan perundang-undangan yang berlaku; (2) Penting sekali adanya sosialisasi dari pihak Badan Pertanahan Nasional; (3) Upaya-upaya PPAT dalam mengatasi faktor-faktor yang menjadi kendala dalam Pensertipikatan Tanah Hak Milik tidak menyimpang dari persyaratan hukum yang harus dipenuhi oleh pihak yang berkepentingan. Kata Kunci : PPAT, Pendaftaran Tanah ABSTRACT TITLE : THE ROLE OF PPAT WHILE CARRYING LAND PROPERTY CERTIFICATION ON JEPARA REGENCY This research has purpose to: (1) describe role of PPAT within implementation of private owned land property certification on Jepara Regebcy; (2) describe any restriction factors against PPAT when implementation of private owned land certification on Jepara Regency; and (3) Examine PPAT’effort while overcome cumberer factors of the implementation of private owned land property certification on Jepara Regency. This analytical descriptive research used empirical juridical approach. This research was done on Jepara Regency. Data gathering method used acoording to its type, they are: (1) primary data gathering, which has done through interview, and (2) secondary data gathering that is performed by ;iteratureexamination. Data gathering processing was used trianggulation method, colleague checking, and sufficient reference. Data analysis in this research was done qualitativelly, that is, the gathered data willbe arranged systematically then analitically quantify to explain the examined problems. The results of the research show that (1) PPAT take highly role for giving certainty and legal protection, also, private owned land property administration rule, such Government Regulation No. 24 1997, Government Regulation No. 37 1998, Head of BPN Regulation No. 1 2006; (2) while perform such land certification, PPAT faced several constraints, they are: (a) incomplete land certificate in result required village certificate (b) lack of witnesses who corrobote land borders for determined such land owned right, (c) unclear NJOP (Tax Object Sell Value), thus it can not determine its BPHTB tax amount; (3) as effort to overcome contraint factors during certifiction of private owned land property , PPAT will return bundles in order to meet its requirements, i. E. Asking the related parties to: (a) complete bundle with the certificate of dealt land; (b) complete any witnesses upon land borders that will be certificated, (c) manage the running years NJOP to PBB office. Based on just mentioned conclusion, it’s suggested that: (1) As PPAT was highly play role on implementation of private owned land property, it’s wished that may keep such role by doing task in appropriate with the private legal; (2) to minimize any occured constraints on implementation of private ownd land property, it’s very important to hold periodically socialization from National Land Affair Bodies; (3) PPAT’s effort for overcoming any constraint factors during make certificate on private owned land property mus be always in appropriate with the main problems, thus it will not deviate from legal regulation that must be obeyed by the interst parties. Therefore certainly, legal protection, and administration order of land certification still watched out. Keywords: PPAT, Private Land
