Abstract
ABSTRAK Kedudukan Notaris Selama Menjadi Anggota Dewan Perwakilan Rakyat Seorang notaris yang menjadi anggota Dewan Perwakilan Rakyat, wajib cuti atau berhenti. Tujuan penelitian mengetahui status hukum dan pertanggung jawaban atas akta-akta yang dibuat sebelum notaris menjadi anggota Dewan Perwakilan Rakyat. Sifat penelitian yuridis normatif, yang dilakukan di perpustakaan dan lapangan dengan alat pengumpul bahan hukum studi dokumen dan wawancara notaris di Semarang Berdasarkan analisis kualitatif diketahui terdapat 2 (dua) peraturan yang mengatur notaris menjadi anggota Dewan Perwakilan Rakyat, pertama menurut Pasal 17 huruf d juncto Pasal 11 UUJN, notaris diwajibkan mengajukan cuti, kedua menurut Pasal 50 ayat (1) huruf l, notaris diwajibkan berhenti. Berdasarkan asas lex specialis derogat legi generali, maka seorang notaris yang menjadi anggota Dewan Perwakilan Rakyat wajib cuti. Selama menjadi anggota Dewan Perwakilan Rakyat, notaris menunjuk notaris pengganti, dan notaris bertanggung jawab atas aktaakta yang dibuat sebelum menjadi anggota Dewan Perwakilan Rakyat. Kata kunci: Notaris, DPR, cuti, pertanggungjawaban. ABSTRACT Public Notary Position When Become As Legislative Member A notary becomes Legislative Assembly is obliged to leave his/her duty or resign. Research purpose is to know legal status and responsibility on deed were made by notary before he/she becomes Legislative Assembly. The research characteristic is normative juridical, conducted in the library research and field research by means of legal material and notary interview in Semarang. Based on qualitative analysis is recognized that there are two rules regulating notary to become Legislative Assembly member, first according to Section 17 letter d juncto Section 11 UUJN, notary is obliged to submit a furlough, second, according to Section 50 article (1) letter I notary is obliged to resign. Based on lex specialis derogat legi generali principle, so a notary who become a Legislative Assembly member is obliged to leave his/her duty. While he/she is a member of Legislative Assembly, notary appoint a successor and notary has responsible on its official documents were made before he/she becomes Legislative Assembly.
