UPAYA PENENTUAN STATUS HAK PENGUASAAN DAN PENGGUNAAN TANAH PT. KERETA API OLEH MASYARAKAT (STUDI KASUS DI KABUPATEN DEMAK)

Abstract

ABSTRAK “Upaya Penentuan Status Hak Penguasan Dan Penggunaan Tanah PT. Kereta Api Oleh Masyarakat ( Studi Kasus Di Kabupaten Demak)” Salah satu masalah pokok yang hingga kini belum mendapat pengaturan tuntas adalah masalah tanah, dan telah banyak konflik yang terjadi, begitu pula yang terjadi di emplasemen tanah PT. Kereta Api yang ada di Kabupaten Demak dimana terdapat penggunaan dan penguasaan tanah secara fisik oleh masyarakat dan penguasaan yuridis oleh PT. Kereta Api, bisa dikatakan terdapat suatu ketidakpastian hukum hak atas tanah. Penelitian ini menggunakan metode penelitian yuridis empiris, Spesifikasi Penelitian menggunakan penelitian deskriptif analitis, Teknik penarikan sampel dilakukan dengan cara teknik non random sampling dengan jenis sampel purposive sampling. Metode dan teknik pengumpulan data diperoleh melalui data primer dan data sekunder. Metode analisis data mempergunakan metode analisis kualitatif. Hasil penelitian adalah sebagai berikut: Pengaturan hukum tentang penggunaan dan penguasaan tanah PT. Kereta Api oleh masyarakat di Kabupaten Demak diatur di Penataan Ruang di wilayah setempat Undang-undang No.24 Tahun 1992. Pengaturan lebih rinci dalam surat Keputusan Direktur Djendral Kepala Djawatan Kereta Api, No 20912/BB/1962 tentang asal mula Dasar hukum dilaksanakan sewa-menyewa, Inpres No.5 Tahun 1988 tentang Pedoman Penyehatan dan Pengelolaan BUMN, kemudian ditindaklanjuti dengan Kep. Menkeu No. 740/KMK.00/1989 tentang Peningkatan Efisiensi dan Produktifitas BUMN, lebih khusus lagi dalam Undang-Undang Perbendaharaan Negara (ICW), Inpres No. 9 Tahun 1970 dan Kepres No. 16 Tahun 1994 tentang Pemanfaatan Tanah Perusahaan Kereta Api dan diperbaharui di Undang-Undang No.1 tahun 2004. Perkembangan penguasaan dan penggunaan tanah PT.Kereta Api di Kabupaten Demak yaitu secara yuridis tanah emplasemen Kabupaten Demak itu dimiliki oleh PT. Kereta Api dan secara fisik dikuasai dan dipergunakan oleh masyarakat untuk pemukiman/perumahan. Jaminan kepastian hukum hak atas tanah di emplasemen masyarakat Kabupaten Demak juga belum ada. Upaya yang dapat dilakukan terlebih dahulu adalah masyarakat mengajukan permohonan kepada PT. Kereta Api untuk segera mansertipikatkan tanah PT. Kereta Api menjadi suatu hak tertentu. Apabila PT. Kereta Api sudah mendapat hak pengelolaan maka bisa diberikan hak atas tanah di atasnya yaitu HGB bagi masyarakat dan Hak pakai bagi Instansi pemerintah. Solusi lain, dilakukan dengan jalan PT. Kereta Api melakukan upaya meminta kepada perusahaan untuk mencoret tanah yang ada di emplasemen Kabupaten Demak itu untuk dikeluarkan dari daftar aset perusahaan(Persero), untuk menjadi tanah negara bebas dan masyarakat dapat memohonkan tanah negara bebas tersebut kepada Menteri Negara Agraria/Kepala BPN untuk menjadi status hak tertentu, dengan persetujuan Presiden/ Menteri Keuangan. Kata Kunci : Penentuan status, Penguasaan Tanah, Tanah PT. Kereta Api. ABSTRACT “Efforts in Determining of PT. Kereta Api Land Ownership and Use by Local People (A Case Study in Demak Regency)” One of major problems that recently have yet to be legally resolved is land problem as many conflicts may be found within. This phenomenon ocurred in emplacement of land owned by PT. Kereta Api in Demak Regency. The problem related to physical land ownership and use by local people and judicial ownership by PT. Kereta Api. The study used a juridical empirical method with an analytical descriptive specification. Samples of the study were collected by a non random sampling technique with purposive sampling type. Method and technique of data collection were obtained from both primary and secondary data. These data were then subject to an analysis using a qualitative method. Results of the study were as follows: legal treatment of PT. Kereta Api land ownership and use by local people of Demak Regency was stipulated under the local Spatial Arrangement of Local Act No. 24/1992. The more detailed regulations were explained by Keputusan Direktur Djendral Kepala Djawatan Kereta Api, No. 20912/BB/1962 on the Origins of Hiring Legal Basics, Presidential Instruction No.5/1988 on State-owned Corporate Body (BUMN) Surveillance and Management, followed by Minister of Finance Decree No.740/KMK00/1989 on Efficiency and Productivity Improvement of State-owned Corporate Body, and, in particular, ICW, Presidential Instruction No.9/1970, and Presidential Decree No.16/1994 on Perusahaan Kereta Api Land Use, which was amended by Act No.1/2004. The development of PT. Kereta Api land ownership and use in Demak Regency, on which juridical land emplacement was situated, was physically owned and used by local people for settlements. Legal certainty warrant of the rights on land emplacement in Demak was also absent. They could only go as far as with Hiring and Contract Agreement and Assignment Letter from The Head (Regent) of Demak Regency. However, such notifications were not among official documents for land ownership. Efforts that can be taken by the authorities can be a proposal to PT. Kereta Api for certifying the land it owns. Once the Company has already had rights to manage, it may claim its rights on land ownership. Another soultion can be removal of land ownership by PT. Kereta Api where the emplacement area is situated from the Company’s assets and hand the land over to the ownership of the local people under the instruction of the Minister of Land Management/Head of National Land Management Office, with the agreement of the Minister of Finance.
