Abstract

The objective of these research is to understand the implementation of General Agreement on Trade in Services in the International Air Transport, especially its economic aspects, and to understand the implications of the implementationnof OATS to the Indonesia air transport. The used approach of these research is legal research and its analysis conducted by qualitative. The used sicita is secondary data (document study and library). The results show that implementation of the GATS (Genraal Agreement on Trade in Services) principles not cover economic rights of the main international air transport service (hard rights). Its implementation just covers secondary economic rights of the air transport service. The implications of the implementation of OATS principles not influences the Government of the Republic of Indonesia, especially to the aircraft maintanaice entrepreneur, sale of international air transport savice and CRS including to the government that enforces the regulation of the air transport services. Penelitian ini bertujuan untuk mengetahui implementasi prinsip-prinisp OATS (General Agreement on Trade in Services) dalam jasa angkutan udara internasional, khususnya aspek ekonomi jasa angkutan udara intemasional, dan untuk mengetahui implikasinya bagi jasa angkutan udara Indonesia. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif. Analisis terhadap implementasi GATS dan implikasinya dilakukan sec= kualitatif Data yang digunaho adalah data sekunder yang dibatasi pads stucli dokumen dan bahan pustaka saja. patelitian menunjukkan bahwa penerapan ketentuan/prinsip-prinsip GATS tidak mencakup hak ekonomi jasa angkutan udara internasional yang utama (hard rights). Penerapannya hanya pada hak-hak ekonomi penunjang jasa angkutan udara (soft rights). Akibat start bagi jasa angkutan udara Indonesia tidak berpengaruh, baik terhadap pengusaha jasa bengkel pesawat udata, penjualan jasa angkutan udara intemasional dan CRS, maupun bagi pemerintah yang melaksanakat pengaturan terhadap ketiga jasa angkutan udara tersebut.
