PENERAPAN UNDANG-UNDANG NOMOR 27 TAHUN 2007 TENTANG PENGELOLAAN WILAYAH PESISIR DAN PULAU-PULAU KECIL DALAM MENGEMBANGKAN KAWASAN BAHARI TERPADU DI KABUPATEN PURWOREJO

Abstract

The Law on Regional Government gives authority to the region which have a sea territory to manage its coastal areas. As one of the regions with sea territory Purworejo Regency is managing its coastal areas based on an integrated regional policy as can be seen on the Local Legislation Num.11 Year 2004 on the Integrated Maritime Zone. This local legislation generally regulated the basis, objectives, aim and principles of the management of coastal area in Purworejo Regency. In 2007 the Indonesia government issued Law No.27 Year 2007 on the Management of Coastal Areas and Small Islands as the basic legal management of coastal areas in Indonesia Based on the background, the problems thus formulated on how the the Law. 27 Num. 2007 on the Management of Coastal Areas and Small Islands on the purpose of developing an Integrated Maritime Zone in Purworejo Regency should be implemented, obstacles there are and the efforts that can be done to develop the Integrated Maritime Zone in Purworejo Regency. By using the of judicial normative methods and descriptive analytic research specifications, the author tries to explains about the implementation of the Law No.27 Year 2007 on the Management of Coastal Areas and Small Islands and its obstacle and the efforts that can be done to develop the Integrated Maritime Zone in Purworejo Regency. Research obtained is that Purworejo Regency has implemented the Law No.27 Year 2007 on the Management of Coastal Areas and Small Islands in managing its coastal area by, among others, carrying out communityempowerment, institutional cultivation, establishing cooperation withuniversties, both public and the private sector, and building the necessary infrastructure, which are summarized in a planning design in the form of a strategic plan and zoning plan The conclusion obtained is that the Law No.27 Year 2007 on the Management of Coastal Areas and Small Islands has been carried out in Purworejo Regency BY the implementation of the Local Legislation Num.11 Year 2004 on the Integrated Maritime Zone, even though adjustments to the Law No.27 Year 2007 on the Management of Coastal Areas and Small Islands , which mean that the Local Legislation Num.11 Year 2004 on the Integrated Maritime Zone should be revised in accordance to the new law or the Purworejo government should create a new local legislation altogether on the Integrated Maritime Zone which is fully in line with the new law. Undang-undang tentang Pemerintahan Daerah memberikan kewenangan kepada daerah yang memiliki wilayah laut untuk melakukan pengelolaan di wilayah pesisirnya. Sebagai daerah yang memiliki wilayah laut, Kabupaten Purworejo melakukan pengelolaan wilayah pesisir dengan berdasarkan pada suatu kebijakan daerah yang tertuang dalam Perda No.11 Tahun 2004 tentang Kawasan Bahari Terpadu. Perda ini mengatur secara umum mengenai asas, maksud, tujuan,dan prinsip pengelolaan wilayah pesisir di Kabupaten Purworejo. Pada tahun 2007 pemerintah mengeluarkan Undang-undang No.27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-pulau Kecil sebagai dasar hukum pengelolaan wilayah pesisir di Indonesia. Berdasarkan latar belakang tersebut maka dirumuskan permasalahan bagaimanakah penerapan UU No. 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil dalam rangka pengembangan Kawasan Bahari Terpadu di Kabupaten Purworejo, hambatan-hambatan yang ada serta upaya – upaya yang dapat dilakukan untuk mengembangkan Kawasan Bahari Terpadu di Kabupaten Purworejo Dengan menggunakan metode yuridis normatif dan spesifikasi penelitian deskriptif analitis, penulis berusaha menjelaskan tentang penerapan UU Pengelolaan Wilayah Pesisir dan Pulau-pulau Kecil dan hambatannya serta upaya yang dapat dilakukan untuk mengembangkan Kawasan Bahari Terpadu di Purworejo. Hasil penelitian yang diperoleh adalah bahwa Kabupaten Purworejo melakukan penerapan UU No. 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil dalam pengelolaan wilayah pesisirnya antaralain dengan melakukan pemberdayaan masyarakat, penguatan kelembagaan, mengadakan kerjasama dengan para pihak baik perguruan tinggi maupun swasta, dan pembangunan fisik yang terangkum dalam suatu design perencanaan dalam bentuk rencana strategis dan rencana zonasi. Kesimpulan yang diperoleh bahwa penerapan UU No. 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil di Kabupaten Purworejo telah dilakukan dengan pelaksanaan Perda No 11 Tahun 2004 walaupun masih diperlukan penyesuaian dengan UU No. 27 Tahun 2007 tentang Pengelolaan Wilayah Pesisir dan Pulau-Pulau Kecil tersebut,sehingga perlu dilakukan upaya pengaturan hukum baru mengenai pengelolaan wilayah pesisir dengan merevisi atau membuat perda baru KBT yang sesuai dengan ketentuan perundangan pengelolaan wilayah pesisir.
