IMPLEMENTASI UNDANG - UNDANG NOMOR 22 TAHUN 1999 DAN UNDANG - UNDANG NOMOR 32 TAHUN 2004 DALAM PELAKSANAAN OTONOMI DESA

Abstract

This thesis is to study the implementation of the Act Number 22 Year 1999 and the Act Number 32 Year 2004 in the realization of Village Autonomy. This study apply the juridical-normative approach, which is characteristical by bibliographical research covering the inventory of positive laws. The implementation of the Act Number 22 Year 1999 and the Act Number 32 Year 2004 in the realization of Village Autonomy is in the way of governmental law materials, such as in the Regency of Pati, that has executed the materials of the Act Number 22 Year 1999 and based on the Decision of the Minister of Internal Affairs Number 64 and also 65 concerning the General Guidance of Village Regulation. Meanwhile, the period of the Act Number 32 Year 2004, the Government of that Regency has not established any product of Regional Ordinances. The constraints of the Implementation of the Act Number 22 Year 1999 and the Act Number 32 Year 2004 in the realization of Village Autonomy are the Stipulation of Articles concerning Village; Substance of Village Discussion Board; Substance of Village Regulation; Competence and Authority of the Head of Village; People’s Autonomy Rights; the Orientation of the Head of Village’s servitude; and the influence of complex bureaucracy. The efforts conducted by the government to overcome the constraints of the execution of Village Autonomy based on the Act Number 32 Year 2004, are the Confirmation of the Meaning of Village, Regulation of the Authority of Village, Regulation of the Procedure of the Election of the Head of Village, Establishment of Servicing Period of the Head of Village and the Existence of Village Secretary from the element of State Officers, Establishment of Function and Existence of Village Discussion Board and Community Board, and the Organization of Village Financial Resource. Penulisan tesis ini untuk mengkaji implementasi dan kendala yang dihadapi Undang-undang Nomor 22 Tahun 1999 dan Undang-undang Nomor 32 Tahun 2004 terhadap pelaksanaan Otonomi Desa. Metode pendekatan dalam penelitian ini adalah penelitian hukum yuridis empiris merupakan penelitian kepustakaan yaitu penelitian terhadap data sekunder meliputi inventarisasi hukum positif. Implementasi Undang-undang Nomor 22 Tahun 1999 dan Undang-undang Nomor 32 Tahun 2004 terhadap pelaksanaan otonomi desa yakni secara materi hukum pemerintah, misalnya Kabupaten Pati, telah melaksanakan materi Undang-undang Nomor 22 Tahun 1999 dan didasari Keputusan Menteri Dalam Negeri Nomor 64 serta 65 Tentang Pedoman Umum Pengaturan Desa dan Kelurahan. Sedangkan masa periode Undang-undang Nomor 32 Tahun 2004 Pemerintah Kabupaten tersebut belum menetapkan produk Peraturan Daerah. Sedangkan Kendala implementasi Undang-undang Nomor 22 Tahun 1999 dan Undang-undang Nomor 32 Tahun 2004 terhadap pelaksanaan otonomi desa, adalah Pengaturan Pasal-pasal tentang Desa; Substansi Badan Permusyawaratan Desa; Substansi pengaturan Desa; Wewenang dan kekuasaan Kepala Desa; Hak otonomi rakyat; Orientasi pengabdian kepala desa; dan pengaruh birokrasi yang kompleks.
