BENTUK –BENTUK LISENSI DAN PELANGGARAN LISENSI PROGRAM KOMPUTER (STUDI LISENSI PROGRAM KOMPUTER MICROSOFT)

Abstract

The research upon the form of License and the License Violation of the Computer Program (the Study of Microsoft Computer Program) is to acknowledge the license type possessed by Microsoft and the license form and to acknowledge the effort to solve and prevent the license violation, by the government either through the law enforcer or through socialization completed by the vendor or the educational institution. The research used juridical empirical method completed upon several institutions / educational institutions such as university, which were UNISBANK, UNAKI, and UDINUS in Semarang, and involving the retail companies that provide software and hardware for the public. The research possesses background of the State importance upon the intellectual property protection until the international level, especially upon the computer program. License as the shape of the authorization given by the owner / the copyright holder, commonly, is not considered properly by the user, which causes moral or economical loss. The research result shows that Microsoft as the owner / the copyright holder upon the computer program, basically, has provided various forms of licenses appropriated to the usage purpose. Nevertheless, upon the research result, there are license clausal in which the characteristic does not provide the equal position between the provider and the acceptor of the license. It is worsened by the cost upon the license, which is economically burdened the user, as the consequence ; there would be many violations. The conclusion is that the society usually only uses the license upon the license volume and special agreement. It is caused by the cost factor. The violations upon the license are happened either intentionally or unintentionally. It is understanding of the license correctly. UUHC is not regulating distinctly / specifically upon the computer program license. Penelitian mengenai bentuk – bentuk Lisensi dan Pelanggaran Lisensi Program Komputer (Studi Lisensi Program Komputer Microsoft) bertujuan untuk mengetahui lisensi jenis apa saja yang dimiliki oleh Microsoft dan bentuk lisensi. Penelitian ini juga bertujuan untuk mengetahui pelanggaran – pelanggaran yang terjadi atas lisensi program komputer Microsoft dan upaya yang dilakukan untuk mengatasi dan mencegah pelanggaran lisensi, baik oleh pemerintah melalui aparat penegak hukumnya dan melalui sosialisasi yang dilakukan oleh pihak vendor maupun lembaga pendidikan. Penelitian ini menggunakan metode yuridis empiris yang dilakukan terhadap beberapa institusi / lembaga pendidikan seperti universitas yaitu UNISBANK, UNAKI dan UDINUS di Semarang, serta melibatkan perusahaan retail yang menyediakan software dan hardware untuk umum. Penelitian ini dilatarbelakangi bahwa pentingnya negara melindungi karya intelektual sampai pada tingkat internasional, khususnya untuk program komputer. Lisensi sebagai bentuk perizinan yang diberikan oleh pemilik / pemegang hak cipta sering sekali tidak diperhatikan oleh pengguna, sehingga mengakibatkan kerugian yang bersifat moral maupun ekonomi. Hasil Penelitian menunjukkan bahwa Microsoft sebagai pemilik / pemegang hak cipta atas program komputer pada dasarnya telah menyediakan berbagai bentuk lisensi sesuai dengan tujuan penggunaannya. Namun dari hasil penelitian bahwa terhadap klausula lisensi masih ada yang sifatnya tidak memberikan posisi yang seimbang antara pemberian dengan penerima lisensi. Didukung lagi dengan biaya yang harus dibayarkan atas lisensi tersebut, secara ekonomi memberatkan pengguna, sehingga terjadi bermacam – macam pelanggaran. Kesimpulannya yaitu bahwa masyarakat pada umumnya hanya menggunakan bentuk lisensi dengan jenis volume lisensi dan special agreement. Hal ini dilatarbelakangi faktor biaya. Pelanggaran yang terjadi terhadap lisensi Microsoft ini terjadi baik disadari ataupun tidak disadari. Tidak disadari karena masyarakat belum memahami konsep dan pengertian lisensi secara baik. UUHC juga tidak mengatur secara jelas / spesifik mengenai lisensi program komputer.
