PENGEMBANGAN RESTRUKTURISASI PT KERETA API (PERSERO) DIVISI ANGKUTAN PERKOTAAN JABOTABEK

Abstract

The research is aimed to study factors of motive for PT Kereta Api Corporation - City Railway (JABOTABEK) Division restructurization, to understanding its restructurization requirements, and also to describe the restructurization developing. The research method concerning specification is descriptive research, dogmatic-empirical law approach. That’s everything, seen based on people to be informant point of views. Research’s location is in Jakarta Pusat PT Kereta Api (Persero) Jabotabek Division Office. Data consists of primary and secondary data. The collection of data is done by interview, library study, and observation. Samples taken by purposive and snowball sampling. Data Analyses use qualitative analyses with inductive thinking pattern to deductive. Based on result of research and analyses can be summarized that the developing of PT Kereta Api- the city rail Division – restructurization is motived by Yuridical Factor and Non Yuridical Factors : economical, social-cultural, and government-political factors. The requirements for restructurization execution conform the principles on the Law Number 1 of 1995 about Limited Corporation, and the Act Number 19 of 2003 on Business Interprises the State. The execution of restructurization developing is done by the Team of Interdepartemental Coordination as Steering Committee, and the Transportation and Communication Minister form the Team of Policy ececutive for he Real-way Development, cooperation with World Bank, also be formed the Team Restructurization executive Penelitian tesis ini ditujukan untuk mengkaji faktor pendorong pengembangan restrukturisasi PT Kereta Api Divisi Angkutan Perkotaan JABOTABEK, memahami persyaratan restrukturisasinya, serta mendeskripsikan pelaksanaan pengembangan restrukturisasi tersebut. Dari tujuan seperti itu digunakan metoda: spesifikasi penelitian ini merupakan penelitian diskriptif, dengan pendekatan normative – empirik. Lokasi pada PT Kereta Api (Persero) Divisi Angkutan Perkotaan JABOTABEK di Jakarta Pusat. Digunakan Data Primer dan Data Sekunder. Pengumpulan data dengan wawancara, studi pustaka, dan observasi, dengan teknik purposive sampling. Data yang diperoleh secara sistematis dianalisa dengan menggunakan analisis kualitatif. Diperoleh hasil simpulan bahwa pengembangan restrukturisasi PT KERETA API (Persero) Divisi Angkutan Perkotaan JABOTABEK didorong oleh Faktor Yuridis dan Faktor Non Yuridis : faktor ekonomi, faktor sosial budaya, dan faktor politik pemerintahan. Persyaratan untuk melakukan restrukturisasi tersebut sesuai dengan prinsip-prinsip dalam Undang-Undang Nomor 1 Tahun 1995 tentang Perseroan Terbatas, dan Undang-Undang Nomor 19 Tahun 2003 tentang Badan Usaha Milik Negara. Pelaksanaan pengembangan restrukturisasinya dilakukan oleh suatu Tim Koordinasi Interdepartemen selaku Tim pengarah. Kemudian Menteri Perhubungan membentuk Tim Pelaksana Kebijaksanaan Pengembangan Perkerata-apian, bekerjasama dengan Bank Dunia. Pada tingkat pelaksana lebih riil dibentuk Tim Pelaksana Restrukturisasi Perkereta-apian.
