PELAKSANAAN SERTIFIKASI TANAH WAKAF DI KOTA BANJARMASIN

Abstract

Upon the Islamic Law, there are plenty of known-methods to secure rights on land, and among the vast amount of the achievement title or the transferring upon the Islamic Law; the most considerable matter is upon wakaf/ property donated for the community use. Upon the importance of wakaf land, in order to warrant the execution effectiveness of the land wakaf process, it needs to have the close surveillance and upon Section 13 of the Government Regulation No. 28 Year 1977, which states that the surveillance of the owned property and the regulation upon the area is stipulated further by the Regulation of the Minister of Religion and then continued with section 14 of the Regulation of the Minister of Religion No. 1 Year 1978 that states that the surveillance and the counseling of the land wakaf process is completed by the organization unit of the Department of Religion affairs upon hierarchal term that is ruled within the Decision of the Minister of Religion upon the Organization Structure of the Procedure of Department of Religion. Because of the matter, the role of District Religion Affair Office is very important upon the execution of wakaf land certification, and upon the practice, there are still obstacles upon the process. The research discusses about the matter of the certification execution of wakaf land and the risen obstacles upon 5 (five) districts of Religion Affair Office of Banjarmasin. The research used descriptive analytical upon the execution of the certification of wakaf land and the risen obstacles. The research describes the reality on the field, whereas the sampling method was purposive sampling with the data collection that was based on primary and secondary data and supported also with literature. The execution of wakaf land handling by District KUA in Banjarmasin city possesses the long period procedural process, which is bureaucratic upon the certification management that is not distinct upon who is the real fund provider. Plenty of wakaf lands are upon the green line (close to the river and the government road). The obstacles that cause the society do not make wakaf land certificate is the less-consideration of the society whereas there is the attitude of simplifying the importance of wakaf land certificate, as long as upon the land, there lies the mosque, most of the people will only state a vow in front of Nadzir (the mosque management officer) and witnesses without confronting the PPAIW (Pejabat Pembuat Akta Ikrar Wakaf/ the Wakaf Certificate Issuer Officer). The execution, in one side, establishes ease since it does not need intricate procedure, however in the other side, it can threaten the legal status of the wakaf land. Thus the existence of wakaf land in Banjarmasin should be certified in the Land Affair Office in order to provide warranty of the law certainty. Didalam Hukum Islam dikenal banyak cara untuk mendapatkan hak atas tanah, dan diantara banyak titel perolehan atau peralihan dalam Hukum Islam tersebut yang paling banyak mendapat perhatian adalah masalah perwakafan. Menyadari arti pentingnya tanah wakaf, maka untuk lebih menjamin efektifnya pelaksanaan perwakafan tanah maka diperlukan pengawasan yang ketat dan menurut pasal 13 Peraturan Pemerintah No. 28 Tahun 1977 maka pengawasan tanah milik dan tata caranya diberbagai wilayah ditetapkan lebih lanjut oleh Menteri Agama dan kemudian ditindak lanjuti dengan pasal 14 Peraturan Menteri Agama No. 1 Tahun 1978 yang menyatakan bahwa pengawasan dan bimbingan perwakafan tanah dilakukan oleh unit organisasi Departemen Agama secara hirarkis yang diatur dalam keputusan Menteri Agama tentang Struktur Organisasi Tata Kerja Departemen Agama. Maka peran kantor urusan agama kecamatan sangat penting dalam pelaksanaan sertifikasi tanah wakaf, dan didalam praktek di lapangan masih banyak dijumpai kendala yang menghambat dalam proses sertifikasi tanah wakaf tersebut. Penelitian ini mengangkat persoalan pelaksanaan sertifikasi tanah wakaf dan kendala yang dihadapi, penelitian ini bertujuan untuk memahami pelaksanaannya di 5 (lima) wilayah kecamatan Kantor Urusan Agama Banjarmasin. Penelitian ini menggunakan metode yuridis empiris, spesifikasi penelitian bersifat deskriptif analitis tentang pelaksanaan sertifikasi tanah wakaf dan kendala yang dihadapi. Penelitian ini menggambarkan apa adanya keadaan lapangan, sedangkan tehnik penentuan sample yang digunakan adalah purpossive sampling dengan tehnik pengumpulan data berdasarkan pada data primer dan sekunder serta didukung oleh daftar perpustakaan. Pelaksanaan penanganan tanah wakaf oleh KUA kecamatan di kota Banjarmasin tampak prosedurnya cukup panjang yaitu sangat birokratis dalam pengurusan sertifikasi, tidak jelas siapa yang membiayai dana sertifikasi, banyak dijumpai tanah wakaf berada di jalur hijau (dipinggir sungai dan jalan pemerintah), kemudian kendala yang menyebabkan masyarakat untuk tidak membuat sertifikat wakaf disebabkan kurangnya kesadaran masyarakat yang belum maksimal dimana adanya sikap penyederhanaan terhadap pentingnya sertifikat tanah wakaf, selama diatas tanah tersebut berdiri bangunan fisik masjid atau musholla, sebagian masyarakat hanya mengucapakan ikrar dihadapan nadzir (Pengurus masjid, musholla) dan saksi-saksi tidak dihadapan PPAIW (Pejabat Pembuat Akta Ikrar Wakaf). Pelaksanaan yang demikian disatu pihak lebih memudahkan karena tidak memerlukan prosedur dan tatacara yang rumit, akan tetapi dilain pihak dapat mengancam status hukum dari tanah wakaf tersebut, oleh sebab itu keberadaan tanah wakaf di kecamatan-kecamatan kota Banjarmasin harus segera disertifikasi ke Kantor Pertanahan dengan tujuan memberikan jaminan kepastian hukum.
