Privatisasi Badan Usaha Milik Negara (BUMN) dilaksanakan dengan alasan karena kinerja Badan Usaha Milik Negara (BUMN) rendah, tidak sehat serta kemampuan pemerintah untuk memberi subsidi semakin rendah. Privatisasi BUMN dengan opsi penjualan saham langsung kepada investor diterapkan pada PT Telkom Jawa tengah Kebijaksanaan tersebut mengacu pada Pasal 78 UU No. 19 tahun 2003 tentang BUMN yang meninggalkan jiwa dan semangat Pasal 33 UUD 1945. Penjualan saham dilakukan kepada investor asing tanpa batas prosentase jumlah saham yang diijinkan undang-undang, maka kemungkinan kepemilikan saham BUMN bepindah ke tangan swasta (asing) semakin besar. Permasalahan yang diteliti meliputi: kebijaksanan privatisasi telah menyebabkan terjadinya pergeseran kebijakan dalam sektor pelayanan publik yang menyimpang dari amanat Pasal 33 UUD 1945 , dan dampak kebijaksanaan privatisasi.bagi kesejahteraan masyarakat. Penilitian ini adalah penelitian kualitatif dengan menggunakan paradigma penelitian Critical Legal Theory, metode pendekatan socio legal research dengan pendekatan kualitatif. Metode penghimpunan data menggunakan metode wawncara, participan observation pasif, dan studi kepustakaan. Analisa data dengan teknik analisa data interpretatif understanding atau verstehen (memahami). Adapun validasi data dengan triengulasi sumber. Kerangka pemikiran guna menentukan landasan teoritik.Dilakukan dengan studi tentang: hukum dan kebijaksanaan publik, birokrasi dalam pelayanan publik, budaya dan budaya perusahaan, karakteristik BUMN, serta bentuk BUMN di masa yang akan datang, dan faktor-faktor yang mendorong terjadinya privatisasi BUMN.. Penelitian yang diperoleh adalah: telah terjadi pergeseran kebijaksanaan pelayanan di sektor publik akibat privatisasi BUMN yang menyimpang dari ketentuan Pasal 33 UUD 1945. Pergeseran terjadi pada makna privatisasi oleh masyarakat, pemilikan saham dan tujuan perusahaan. Dampak yang timbul akibat kebijaksnnaan privatisasi BUMN terhadap pelayanan di sektor publik adalah adanya peningkatan kinerja perusahaan dan pelayanan pada masyarakat yang semakin baik. Hal ini menyebabkan kesejahteraan karyawan khususnya meningkat . Sedangkan dampak negatif yang timbul yaitu re;atif lebih mahal biaya jasa yang harus dibayar oleh konsumen, sehingga akan mengurangi kesejahteraan masyarakat.
