Abstract

Research about the implementation of sell-buy upon ex-propietary right (traditional) lands in Bekasi Regency are to find reasons, people’s reaction, the problems appeared and the law consequences coming from the implementation of sell-buy upon Expropretary right (traditional) lands that has been done in front of the head villages. This researcht used a juridical empirical approaching method conducted in Mekarsari, Jatimulya, Telaga Murni anda Telaga Asih Villages in Bekasi Regency exactly using primaryand secondary data, and the sample determination was conducted using purposive sampling technique. The samples determination was conducted using purposive sampling technique. The samples are the the head of south Tambun District, the head of West Cikarang District, the head of Mekarsari Village, the head of Jatimulya village, the head of Telaga Murni village, the head of Telaga Murni village, the head of Telaga Asih village and 20 (twenty) people come from Mekarsari village, Jatimulya village, Telaga Murni village and Telaga Asih village, each village took 5 (five) person. The result of this research are some reasons wehy the implementation of sell-buy upon ex-proprietary rights (traditional) land done in of the head village. The reasons are because arrangement of sell-buy certificates are processed in village officeces old customs and the existence of permits/approval from PPAT district, people’s reaction concerhing upon are they do not have any objectins, disagree and do not know, the appeared problems are the law knowledge of head village is increase, Incomplete documents and no legal heir, The law consequences emerging from the implementation of sell-buy that has been done in front of the head village are the buyers can not register the appeal of rights to the land affairs office. The buyer will not received the transfer of right land and will have difficulties in proxing their right to the others. The dispute settlement can be done in the level of height bor hood (RT), village and districht where problems are solved in familiar way. If it is failed the the problems are so heed in the court. The condusion is the implementation of sell-buy upon ex-proprietary rights (traditional) land in Bekasi Regency done in front of the head village are uncommon like with Indonesia’s land rules because since UUPA occurd in Indonesia only all certificates made by PPAT which can be used as a based from the transfer of Right Upon Land (Pasal 37 ayat (1) PP No. 24 Tahun l997). Penelitian tentang pelaksanaan jual-beli tanah bekas hak milik (adat) di Kabupaten Bekasi bertujuan untuk mengetahui alasan-alasan, tanggapan masyarakat, masalah-masalah yang muncul serta akibat hukum yang timbul dari pelaksanaan jual-beli tanah yang dilakukan dihadapan Kepala Desa. Penelitian ini menggunakan metode pendekatan yuridis empiris yang dilakukan di Desa Mekarsari, Jatimulya, Telaga Murni dan Telaga Asih dengan mempergunakan data primer dan data sekunder serta penentuan sampel dengan cara purposive sampling, yang menjadi sampel adalah Camat Tambun Selatan, Camat Cikarang Barat, Kepala Desa Mekarsari, Kepala Desa Jatimulya, Kepala Desa Telaga Murni dan Kepala Desa Telaga Asih dan 20 (duapuluh) orang yang berasal dari Desa Mekarasari ,Jatimulya, Telaga Murni dan Telaga Asih masing-masing 5 (lima) orang. Hasil dari penelitian yaitu bahwa alasan-alasan jual-beli tanah dilakukan dihadapan Kepala Desa adalah karena pengurusan akta jual-belinya melalui Kantor Desa, kebiasaan dan atas ijin PPAT Camat, tanggapan-tanggapan masyarakatnya yaitu tidak mempermasalahkan, kurang setuju dan tidak tahu, masalah-masalah yang timbul yaitu pengetahuan hukum Kepala Desa berkurang, surat tanahnya tidak lengkap dan ahli warisnya tidak ada, akibat hukum yang timbul dari pelaksanaan jual-beli tanah yang dilaksanakan dihadapan Kepala Desa adalah pembeli tidak dapat mendaftarkan haknya ke Kantor Pertanahan, pembeli tidak memperoleh izin pemindahan hak atas tanahnya dan kesulitan membuktikan haknya kepada pihak lain, penyelesaian sengketa dilakukan melalui tingkat RT, Desa dan Kecamatan dengan cara kekeluargaan apabila tidak selesai diselesaikan di Pengadilan. Kesimpulanya yaitu pelaksanaan jual-beli tanah bekas hak milik (adat) di Kabupaten Bekasi yang dilakukan dihadapan Kepala Desa tidak sesuai dengan hukum tanah di Indonesia sebab sejak UUPA diberlakukan hanya akta-akta yang dibuat oleh Pejabat yang berwenang yang dapat dipergunakan sebagai dasar peralihan hak atas tanah (Pasal 37 ayat (1) PP No. 24 Tahun l997).
