KOLABORASI KEPENTINGAN BISNIS DAN POLITIK DALAM SENGKETA PENGELOLAAN LAHAN TAMBANG

Abstract

Keberadaan Dewan Perwakilan Rakyat Daerah sebagai wakil rakyat menjadi harapan bagi masyarakat dalam menyalurkan aspirasinya. Proses penyusunan APBD dengan sistem bottom up dengan penjaringan aspirasi melalui Musrenbangdes dilanjutkan ke Musrenbang kecamatan dan akhirnya pada Rakorbang pada tingkat kabupaten, pada kenyataannya belum memenuhi harapan masyarakat, karena dalam tahapan penyusunan tersebut banyak usulan pembangunan yang tidak tercover dikarenakan adanya kepentingan politis. DPRD sebagai wakil rakyat diharapkan dapat bersikap proporsional, sebagai lembaga perwakilan mereka harus memperjuangkan semua kepentingan masyarakat tanpa memandang kelompok dan golongan. Semua peran dan fungsi DPRD dalam memperjuangkan aspirasi masyarakat dalam pembangunan daerah tidak terlepas dari adanya tata peraturan yang menjadi pedoman bagi dewan dalam melaksanakan tugas dan fungsinya. Peraturan Menteri Dalam Negeri Nomor 59 tahun 2007 tentang Perubahan atas Peraturan Menteri Dalam Negeri Nomor 13 Taun 2006 tentang Pedoman Pengelolaan Keuangan Daerah sebagai salah satu pedoman bagi dewan dalam menyusun dan membahas Anggaran Pendapatan dan Belanja Daerah dipandang berbeda oleh masing-masing anggota dewan. Latar belakang pendidikan, pekerjaan, dan kepentingan menjadi alasan bagi masing-masing anggota dalam mempersepsikan Permendagri 59 Tahun 2007. Mayoritas anggota dewan berpendapat tidak sesuai dengan harapan mereka. Beberapa hal yang dianggap tidak sesuai adalah pertama, pembahasan Kebijakan Umum Anggaran hanya dibahas oleh Panitia Anggaran DPRD dan Tim Anggaran. Kedua Komisi-komisi DPRD yang mempunyai bidang kerja spesifik dan paling aktif dalam penyelesaian permasalahan didaerah dianggap paling tepat dalam merumuskan kebijakan yang dituangkan dalam Kebijakan Umum Anggaran, sehingga Komisi-komisi DPRD perlu dilibatkan dalam pembahasan Kebijakan Umum Anggaran. Ketiga, pembatasan waktu yang diatur dalam Permendagri sulit dilaksanakan karena dalam realitanya penyerahan Rancangan KUA seringkali terlambat sehingga pembahasan dan penetapan KUA dan RAPBD akhirnya juga tidak tepat waktu yang berakibat mengurangi kinerja pemerintahan. Dengan Permendagri Nomor 59 Tahun 2007 yang dianggap tidak tepat disarankan hal-hal sebagai berikut : Pertama perlu perubahan parsial terhadap Permendagri 59 tahun 2007 khususnya berkaitan dengan pembahasan Kebijakan Umum Anggaran dan Prioritas Plafon Anggaran Sementara yang tidak hanya dibahas oleh Panitia Anggaran dan Tim Anggaran tetapi juga oleh Komisi-komisi DPRD. Kedua perlunya aturan yang menegaskan DPRD perlu membuat rencana kerja yang dilakukan sepenuhnya sehingga kinerja DPRD terarah dan jelas dan pembahasan KUA, PPAS dan RAPBD dapat tepat waktu The presence of Regional House of Representatives Demak Regency as the representative of the public is a hope for the public in promoting their aspiration to the government. Process of making the guidelines of Regional Finance Management in making the regional budget with bottom up system by taking aspiration through Village Development Planning Congress to be continued to Sub-Regency Development Planning Congress and finally to Regency Development Planning Congress. Unfortunately, the reality of their presence doesn’t fulfill the hopes of public aspiration, by the time of making decision; many development aspirations are uncovered because of political affairs and importance. The Regional House of Representatives as the representative of the public is supposed to be more proportional as a representative institution, they have to keep struggling public importance without any individual or group view. All of the Regional House of Representatives roles and function in promoting public aspiration in developing region can’t be separated from the regulations as the council guidelines in performing their tasks and functions. The Domestic Affairs Minister’s Decree No. 59. 2007 about change of The Domestic Affairs Minister’s Decree No. 13. 2006 in context of Regional Budget Guidelines as the basic of Representative Council in making and discussing Educational background, jobs and importance become the reason of each representative in understanding the perception of The Domestic Affairs Minister’s Decree No. 59. 2007. Member of Regional House of Representatives in majority argued that the degrees were not suitable with their ideas. Many cases those don’t suitable with their argument are: First, the discussion about general policy of the budget is discussed only by the budget committee of Regional House of Representatives and Budget team. Second, the Regional House of Representatives commissions who have specific work and active in finishing many problems in regions are selected to be chosen in making the policy in General Budget Policy, so the commissions took a part in discussing General Budget Policy. Third, time limits as have been regulated by The Domestic Affairs Minister’s Decree is quite difficult to be implemented because the reality is the handing over of General Budget Policy is eventually coming late so the discussion and taking decision of General Budget Policy and the regional budget plans are finally out time, and the effect is the inconsistent governmental works. By The Domestic Affairs Minister’s Decree No. 59. 2007 that seems to be incorrect, the solutions are as below: First, it must be a partial change of The Domestic Affairs Minister’s Decree No. 59. 2007 especially which has a relation with the discussion of General Budget Policy and Temporary Budget Plafond Priority which not only needs to be discussed by the budget committee and budget team but also by the commissions of The Regional House of Representatives. Second, there must be a regulation that The Regional House of Representatives needs to plan their works and perform them completely, so The Regional House of Representatives works have a proper destination and clear and then the discussion of General Budget Policy, Temporary Budget Plafond Priority and the regional budget plans is performed on time.
