Abstract
Bank Perkreditan Rakyat (BPR) menyalurkan kredit guna golongan ekonomi lemah/pengusaha kecil, berdasar prinsip collateral dari 5’C, debiturnya wajib menyediakan agunan minimal sebesar jumlah kredit jaminan. Agunan umumnya berupa kendaraan bermotor yang menjadi jaminan di BPR tidak diikat menurut ketentuan hukum UU Nomor 42 tahun 1999 tentang Jaminan Fidusia (UUJF). Eksekusi Jaminan Fidusia yang tidak didaftarkan ke Kantor Pendaftaran Fidusia, di PT. BPR Arthaprima Danajasa Bekasi (BPR) diteliti untuk mengetahui Pelaksanaan Jaminan Fidusia dalam perjanjian kredit BPR, Keuntungan yuridis surat kuasa jual diwaarmerking oleh Notaris, dan Implikasi penyelesaian eksekusi Jaminan Fidusia yang tidak didaftarkan ke Kantor Pendaftaran Fidusia menggunakan metode pendekatan normatif terapan untuk mengkaji penerapan peraturan hukum yang terkait dengan Jaminan Fidusia dan perbankan dengan penerapannya oleh para pihak menggunakan data primer dan data sekunder yang dianalisis secara normatif kualitatif. Pelaksanaan jaminan fidusia di PT. BPR Arthaprima Danajasa Bekasi tidak dituangkan dalam Perjanjian tersendiri melainkan hanya dituangkan di dalam perjanjian kredit dan kuasa menjual yang diwaarmerking berupa Surat Kuasa dengan Hak Substitusi, berarti Jaminan Fidusia tersebut tidak didaftarkan ke kantor fidusia sesuai ketentuan UUJF Pasal 11 dan Penjelasan Pasal 37 ayat (3) namun demikian berdasar Surat Edaran Bank Indonesia direktorat BPR No.9/1/DpG/DPBPR tanggal 2 Mei 2007 diikatnya agunan kendaraan bermotor dengan surat kuasa menjual yang diwaarmerking oleh notaris dinilai 30 % dari harga pasar sebagai pengurang pembentukan Penyisihan Penghapusan aktiva Produktif sesuai Pasal 13 ayat (1) Peraturan Bank Indonesia Nomor 8/19/PBI/2006, impilikasinya surat kuasa menjual yang diwaarmerking berlaku ketentuan Pasal 1320 dan Pasal 1338 KUHPerdata, apabila Debitur wanprestasi gugatan harus melalui proses dipengadilan dan Kreditur berkedudukan sebagai kreditur konkuren sesuai Pasal 1131 dan Pasal 1132 KUHPerdata. Surat kuasa menjual yang diwaarmerking notaris untuk mengikat obyek jaminan fidusia menempatkan Kreditur sebagai kreditur konkuren dan eksekusinya harus dengan kesepakatan antara BANK dan nasabahnya. Bank Perkreditan Rakyat (BPR) useful to distributes credit for low economic group society/small entrepreneurs. Based on the principle of collateral of 5'C, the debtor shall provide guarantee at least as much as the amount of taken guarantee credit. Generally the guarantee/collateral is in form of a motor vehicle that is vouched in the BPR is not bound according to the prevailing legal terms pursuant to the Act Number 42 Year 1999 concerning fidusiary transfer of ownership guarantee. The execution of fidusiary transfer of ownership guarantee that is not registered to fidusiary transfer of ownership registration office at BPR Arthaprima Danajasa Bekasi Co.Ltd., (BPR) was researched to found the implementation of fidusiary transfer of ownership guarantee in the BPR credit agreement, the juridical advantages of an authorization letter to sell required to be registered by the notary, and the implication of execution resolution to the fidusiary transfer of ownership guarantee, which is not registered to fidusiary transfer of ownership registration office. The observation used the applied law approach to examine the implementation of legal regulations related to fidusiary transfer of ownership guarantee and banking system with their application by the parties. It also used collected primary data and secondary data which were analyzed normative-qualitatively. The implementationo of fidusiary transfer of ownership guarantee at BPR Arthaprima Danajasa Bekasi Co.Ltd., is not composed in a separate agreement, however, it is only written in the credit agreement, and the registered authority to sell by notary in form of an Authorization with a Substitution Right in order to withdraw/secure, which means, the fidusiary transfer of ownership guarantee is not registered to fidusiary transfer of ownership Registration Office pursuant to the terms of fidusiary transfer of ownership guarantee Act Article 11 and explanation of Article 37 verse (3). However, based on the Bank of Indonesia Cicular, Directorate of BPR No. 9/1/DpG/DPBPR Date May 2, 2007 regulate the collateral of motor vehicle was bounded with the authorization to sell shall registered by a notary is appraised as much as 30 % of its market price as the subtraction of the formation of Productive Assets Disposal Elimination as mentioned in Article 13 verse (1) of the Regulation of the Bank of Indonesia Number 8/19/PBI/2006, the implication are the authorization to sell the guarantee object shall registered by a notary referring to Article 1320 and Article 1338 of the Civil Code, the prosecution shall process in a court If the debtor violates the agreement, and the creditor is placement as the congruent creditor pursuant to Article 1131 and Article 1132 of the Civil Code prevail. The authorization to sell which shall registered by a notary for fidusiary transfer of ownership guarantee object binding is placement the creditor as the congruent creditor and its execution shall under an agreement between the BPR and its customers.
