PERLINDUNGAN HUKUM KARYA CIPTA BATIK SOLO SEBAGAI KEKAYAAN INTELEKTUAL TRADISIONAL DI INDONESIA

Abstract

Perlindungan terhadap seni batik telah diberikan sejak UUHC 1982, UUHC 1997 hingga UUHC 2002. Namun UUHC tidak mengatur secara jelas mengenai hal-hal apa saja yang menjadi hak bagi pemegang hak cipta seni batik. Hal ini penting karena ketidakjelasan hak-hak mereka akan mengakibatkan ketidakmauan para pembatik untuk mendaftarkan hasil karya seninya. Terlebih lagi apabila menyangkut seni batik yang dihasilkan atau dimiliki secara kolektif karena batik ini dihasilkan oleh lebih dari satu orang pembatik sehingga harus mempertimbangkan kepentingan banyak pihak. Selain ketidakjelasan hak-hak bagi pemegang hak cipta seni batik, sistem pendaftaran yang berlaku saat ini juga merupakan faktor pendukung belum dimanfaatkannya pendaftaran hak cipta oleh para pencipta seni batik. Penelitian ini bertujuan untuk mengetahui dan menganalisisi eksistensi Batik Solo sebagai bagian dari karya tradisional Indonesia, upaya Pemerintah Kota Solo dalam melindungi Seni Tradisional Batik Solo. Dan mengetahui kendala-kendala yang menghambat upaya perlindungan Seni Tradisional Batik Solo oleh Pemerintah Kota Solo. Dengan menggunakan pendekatan yuridis empiris dan spesifikasi penelitian secara deskriptif analitis, maka penulis berusaha menjelaskan eksistensi Batik Solo sebagai bagian dari karya tradisional Indonesia, upaya Pemerintah Kota Solo dalam melindungi Seni Tradisional Batik Solo serta kendala-kendala yang menghambat upaya perlindungan Seni Tradisional Batik Solo. Berdasarkan hasil penelitian diketahui bahwa motif batik asli Solo dimintakan hak cipta, menyusul karya budaya ini banyak dijiplak. Bahkan disebut-sebut telah diklaim sebagai karya negara lain dengan perlindungan hak cipta. Sebagian besar pengusaha kecil dan menengah Batik Solo telah mengetahui adanya hak cipta terhadap motif batik yang diciptakannya. Para pengrajin batik menyadari adanya hak cipta bagi motif batik yang diciptakannya. Namun dalam pelaksanaan kepemilikan hak cipta, prosedur yang kurang dipahami, biaya yang dibutuhkan dalam pengajuan hak cipta serta waktu yang dibutuhkan dalam kepemilikan hak cipta menjadi kendala utama bagi pengrajin. Kaitannya dengan prosedur pengajuan Hak cipta, pengrajin batik kurang memahami bagaimana mereka akan mengajukan hak cipta atas motif batik yang diciptaannya. Hasil penelitian ini merekomendasikan adanya peningkatan usaha perlindungan karya cipta tradisional Batik Solo oleh Pemerintah Kota Solo dengan memberikan kemudahan-kemudahan kepada pengrajin batik dalam mengurus hak cipta motif karyanya. Selain itu juga perlu adanya sosialisasi tentang hak cipta atas karya tradisional Batik Solo agar dapat meningkatkan kesadaran para pengrajin untuk mendaftarkan hak cipta atas motif Batik Solo hasil karya ciptanya The protection for batik arts has been given since the 1982 Copyrights Act, 1997 Copyrights Act, until 2002 Copyrights Act. However, the Copyright Acts does not regulate the matters that become the rights of batik arts copyrights holders clearly. This is important because the uncertainty of their rights will cause reluctance of batik crafters to register their works of arts. Moreover, if it is concerning the collectively created or owned batik arts because they are created by more than one batik crafters, thus, it should consider the interest of many parties. Besides the uncertainty of rights for batik arts copyrights holders, the prevailing registration system in these days also becomes the promoting factor of why the registration of copyrights has not been utilized by the creators of batik arts. This research has the objectives of finding out and analyzing the existence of Batik Solo as a part of Indonesian traditional works, the efforts taken by the Government of Solo City in protecting the Traditional Arts of Batik Solo, and to find out the obstacles that hinder the efforts of Traditional Arts of Batik Solo protection by the Government of Solo City. By utilizing the juridical-empirical approach and descriptive-analytical research specification, therefore, the writer tries to describe the existence of Batik Solo as a part of Indonesian traditional works, what efforts taken by the Government of Solo City in protecting the Traditional Arts of Batik Solo, and also the obstacles that hinder the efforts of Traditional Arts of Batik Solo protection. Based on the research results, it can be found that the original motif of batik Solo is requested for copyrights, since this cultural work has been duplicated frequently. Even, it has been mentioned that it has been claimed as the work of another country with a copyrights protection. Most of small and medium Batik Solo businesses have acknowledged the copyrights of batik motif created by them. The batik crafters have realized the existence of copyrights of batik motif created by them. However, in the execution of copyrights ownership, the less comprehended procedures, required fees for copyrights proposals, and also required time in copyrights ownership become the primary obstacles for the crafters. In relation to the procedures of copyrights proposals, the batik crafters do not comprehend how to propose the copyrights of batik motif created by them well. These research results recommend the improvement of the efforts of traditional work of creation of Batik Solo protection by the Government of Solo City by providing ease for batik crafters in the arrangement of the copyrights of their motif. Besides that, there is a necessity of socialization concerning the copyrights of traditional works of Batik Solo, so that, it may improve crafters’ awareness to register the copyrights of Batik Solo motif as their work of creation.
