Abstract
Perusahaan pengangkutan menggunakan perjanjian baku dalam melakukan perjanjian pengangkutan. Pengangkut telah menyiapkan perjanjian pengangkutan dalam bentuk baku dan pengirim hanya bisa menerima perjanjian tersebut tanpa kesempatan untuk bernegosiasi mengenai isi perjanjian sehingga kedudukan para pihaknya dikatakan tidak seimbang. Dari penggunaan perjanjian baku ini, muncul masalah dalam penerapan asas kebebasan berkontrak karena asas ini hanya dapat diterapkan jika para pihak mempunyai kedudukan yang seimbang. Permasalahan yang lain yaitu dalam hal tanggung jawab pengangkut. Perjanjian baku dibuat oleh pengangkut sehingga pengangkut sewenang-wenang dalam menentukan tanggung jawabnya, salah satunya dalam hal ganti rugi. Dalam penulisan tesis ini, metode pendekatannya dilakukan dengan metode yuridis empiris dengan spesifikasi deskriptif analitis dan analisanya dilakukan secara kualitatif. Hasil dari penelitian ini menunjukan bahwa perjanjian baku dalam perjanjian pengangkutan tidak sesuai dengan asas kebebasan berkontrak karena kedudukan para pihaknya tidak seimbang sehingga tidak ada kebebasan pengirim untuk menentukan isi perjanjian. Pengangkut tidak boleh sewenang-wenang dalam menentukan tanggung jawabnya mengenai ganti rugi. Apabila menurut Undang-Undang kerugian tersebut adalah tanggung jawab pengangkut maka hal tersebut tetap menjadi tanggung jawab pengangkut. Pengangkut tidak perlu membatasi ganti rugi karena telah diatur dalam Undang-Undang No 14 Tahun 1992 tentang Lalu Lintas dan Angkutan Jalan Pasal 45 ayat (2) dimana pengirim berhak mendapatkan ganti rugi yang sesuai dengan kerugian yang dideritanya akibat kesalahan pengangkut. A transport company uses a standard agreement in conducting the transport agreement. The transport company has prepared the transport agreement in a standard form and the shipper can only accept that agreement without having any chance to negotiate the contents of the agreement, thus, the positions of the parties can be said as unequal. From the usage of this standard agreement, there is a problem of the implementation of the principle of freedom to make contract because this principle can only be implemented if the involved parties have an equal position. Another problem is about transporter’s responsibility. The standard agreement is composed by the transporter, thus, it may act arbitrarily in determining its responsibility, and one of them is the matter of compensations. In the composition of this thesis, the method of approach was conducted by using the juridical-empirical method with the descriptive-analytical research specification and its analysis was conducted qualitatively. The results of this research show that the standard agreement in the transport agreement is not in accordance with the principle of freedom to make contract because the position of its parties is unequal, thus, there is no freedom for the shipper to determine the contents of the agreement. The transporter cannot act arbitrarily in determining its responsibility concerning compensations. If according to the law that the loss is transporter’s responsibility, therefore, it still becomes transporter’s responsibility. The transporter does not have to limit compensations because it has been regulated in Act No. 14 Year 1992 concerning Traffic and Road Transportation Article 45 verse (2), in which, the shipper has the right to receive compensations equal to the loss that he or she experienced due to transporter’s fault.
