PELAKSANAAN EKSEKUSI JAMINAN FIDUSIA DI PT BANK INDEX SELINDO CABANG JAKARTA PUSAT

Abstract

Pelaksanaan eksekusi jaminan fidusia diatur dalam Pasal 29 – 34 Undang-Undang No. 42 Tahun 1999 tentang Jaminan Fidusia namun dalam prakteknya masih menimbulkan permasalahan hukum. Dalam halhal tertentu pelaksanaan eksekusi menimbulkan bias dan liku-liku lubang hukum. Hal ini tentunya bukan maksud Undang-Undang Jaminan Fidusia yang mempunyai tujuan utama untuk memperoleh kepastian hukum eksekusi jaminan, sehingga eksekusinya dapat berlangsung dengan mudah, efektif dan efisien Berdasarkan hal-hal tersebut maka permasalahan yang akan diteliti dalam peneltian ini adalah tentang pelaksanaan eksekusi Jaminan Fidusia dalam prakteknya dan hambatan-hambatan serta bagaimana penyelesaiannya. Metode pendekatan yang digunakan adalah pendekatan yuridis empiris dan spesifikasi yang digunakan dalam penelitian ini bersifat penelitian deskriptif analitis. Berdasarkan hasil penelitian dapat disimpulkan bahwa Eksekusi terhadap obyek jaminan fidusia merupakan upaya terakhir yang dilakukan oleh pihak bank apabila terjadi wanprestasi oleh debitur. Eksekusi jaminan fidusia oleh Bank dilakukan terhadap debitur macet melalui pihak yang berwenang yaitu kantor pelayanan piutang dan lelang negara. Eksekusi terhadap objek jaminan fidusia tersebut dilakukan berdasarkan title eksekutorial, dengan pertimbangan bilamana objek jaminan fidusia tersebut telah dilelang dimuka umum oleh pejabat lelang negara serta telah ditetapkan pemenangnya (pembelinya), maka uang hasil penjualan lelang tersebut adalah menjadi hak dan milik Bank. Untuk dapat melakukan eksekusi berdasarkan titel eksekutorial maka pihak bank terlebih dahulu harus meminta fiat/penetapan pengadilan negeri setempat. Tanpa fiat pengadilan maka eksekusi berdasarkan titel eksekutorial tidak dapat dilaksanakan. Hambatan-hambatan yang muncul dalam pelaksanaan Eksekusi Jaminan Fidusia antara lain adalah, Obyek Jaminan fidusia tidak ditemukan, Debitur tidak mau menyerahkan obyek jaminan, Obyek jaminan tidak dalam kondisi utuh. The execution of the fiduciary warranty execution in ruled within Section 29 – 34 of the Code No. 42 Year 1999 upon the Fiduciary Warranty, whereas upon the practice it still the legal consequences. In the special matter, it causes bias and legal complexity. It is not the main purpose of the Code, in which the real purpose is to achieve the law certainty of the warranty execution in order to ease the execution effectively and efficiently. Based upon the matter, the obstacle examined upon the research is upon the execution of the fiduciary warranty execution within the practice and the risen obstacles and the solution. The research used juridical empirical as the approach with the specification of analytical descriptive research. Based upon the research result, it could be concluded that the execution against fiduciary warranty object is the last effort completed by the bank if there is a failure of the debtor. The fiduciary warranty execution is completed by the bank against the failed debtor trough the authorized party, which is the office of the State Credit and Auction Service. The execution is completed based upon executorial title; within the consideration of the auction gain would be returned to the bank. The process of executing the executorial title based execution; the bank should request fiat/the local state court decision. Without fiat, there would not be executorial title based execution. The risen obstacles upon the Fiduciary Warranty execution are the fiduciary warranty object could not be found, the Debtor does not want to surrender the warranty object, and the warranty object is not complete.
