PELAKSANAAN PENGAWASAN NOTARIS SETELAH BERLAKUNYA UNDANG-UNDANG NOMOR 30 TAHUN 2004 TENTANG JABATAN NOTARIS DI KOTA BATAM

Abstract

Kehidupan perekonomian dan sosial budaya yang semakin berkembang dalam masyarakat, memegang peranan yang penting terhadap berkembangnya jasa Notaris bagi masyarakat yang membutuhkan pelayanan akan produk-produk akta dari Notaris. Sebagai pejabat umum, dalam melaksanakan tugasnya Notaris juga harus diawasi agar tidak menyimpang dari peraturan perundang-undangan yang berlaku baginya dan juga harus mampu bertanggung jawab dalam pembuatan suatu akta otentik yang berlaku bagi masyarakat yang membutuhkannya. Pengawasan yang dilakukan terhadap Notaris setelah berlaku Undang-undang Jabatan Notaris dilaksanakan oleh Majelis Pengawas. Sehubungan dengan hal itu maka timbul permasalahan bagaimana pengawas melakukan pengawasan bagi Notaris dalam pelaksanaan tugasnya setelah berlakunya Undangundang Nomor 30 Tahun 2004, dan apakah hambatan dalam pelaksanaan pengawasan Notaris serta upaya penyelesaiannya. Untuk menjawab permasalahan tersebut dilakukan penelitian yang bersifat deskriptif dengan analisis. Lokasi Penelitian di Kota Batam dan responden ditetapkan secara purposive yaitu 3 orang anggota Majelis Pengawas Daerah Kota Batam, 5 orang Notaris dan 1 orang Hakim pada Pengadilan Negeri Batam sebagai narasumber. Data yang diperoleh melalui kepustakaan dan lapangan yaitu dengan cara mewawancarai sejumlah pihak yang terkait. Hasil penelitian diperoleh gambaran bahwa pengawasan oleh Majelis Pengawas setelah berlakunya Undang-undang Nomor 30 Tahun 2004 dilakukan secara lebih preventif dan kuratif. Adapun hambatan dalam pelaksanaan pengawasan oleh Majelis Pengawasan meliputi ketiadaan pengaturan prosedur pengawasan oleh Notaris yang berasal dari organisasi Notaris, pengaruh senioritas Notaris Pengawas dan Notaris yang diawasi, tingkat kepercayaan Notaris yang diawasi terhadap kemampuan Majelis Pengawas dalam menjaga rahasia akta yang dilaporkan serta tingkat kesadaran Notaris terhadap laporan dan pemanggilan oleh Majelis Pengawas. Sedangkan upaya penyelesaiannya adalah dengan jalan mengadakan pertemuan rutin dan berkesinambungan antara Majelis Pengawas dengan para Notaris di Kota Batam. As a public official, in implementing his duties Notary also must be controlled that not deviated from the regulation rules apply for him and also must be capable with responsibility in provide an authentically deed that applied to those community require it. The control that was effected to the Notary done by Supervisor Assembly. With the above matter there emerged a certain problem how Supervisor Assembly hold its control to those Notaries in doing their duties after effective the Acts No. 30 of 2004, either what is the problem do they get in order to control the Notary in doing their duties and how is the solution of those problems. In order to response such problems it has been a study in descriptive by analysis. The location of research taken on Batam city and the respondent was appointed purposively involved 3 Supervisor Assembly, 5 public Notaries and 1 judge for State Court of Batam as informant, the data obtained by library and field research namely by interviewing some people concerned. The result of study there was obtained a description that the control done by Supervisor Assembly after adopting the Acts No. 30 of 2004 seemly conducted was more preventive and repressive. Meanwhile the problem in implementing the control by Supervisor are no existence of the regulating that regulate the control to Notaries that came from Notary’s organization, the impact of senior Notary to the Notaries that controlled, the rate of Notary’s trust to the capability of Supervisor Assembly to keep the secret of the act that is report by Notary and the rate of Notary understanding to the report and calling by Supervisor Assembly. The result of these problem by Notary Supervisor are by making a stimulating and routine meeting between Notary Supervisor and Notaries in Batam City.
