PERLINDUNGAN HUKUM TERHADAP PETERNAK AYAM PEDAGING (BROILER) PADA PROGRAM KEMITRAAN USAHA

Semarang : Law Master's Degree Program Recitation of Economic and Technology Postgraduate Program Diponegoro University In improving small business of broiler breeder, government, with its regulations, makes it compulsory for the breeder to make partnership with purebred chicken breeder. This government's rule is, besides to be the law base in conducting the partnership in business, also able to protect the breeder. In the implementation and application of this rule there are, however, some problems faced to achieve good result. From the result of the research, we can see that the factors effecting the successfulness of the partnership are such as : breeder (plasma) position that is weak, the presence of nucleus domination (breeding company) against the breeder (plasma). Beside that, the role of the government, in this case in the Animal Husbandry Official of Semarang Municipality, is still minimum. Those facts all cause the breeder (plasma) get minimum protection in the partnership agreement, in performing the agreement and in handling with the conflict. All those happen in the phase of fore-producing, in-producing and after producing so that the breeder (plasma) get unfair treatment in the price making and in the sanction and risk deciding. Observed from the view of contract law, the position of the nucleus domination (breeding company) and the breeder (plasma) is not balance, where the position of nucleus domination is stronger than the breder. The constitutional relationship existing between them can, in contact, be stated as special trade relationship. The specific characteristics of that relationship are located in : (1) condition, (2) law position shift, (3) property right shift. From the illustration the writer conclude that the law protection lack of the breeder (plasma) can be overcome by raising the position equality among the partnership participants and raising the role of the government. Dalam rangka pengembangan usaha kecil di bidang ternak ayam broiler, maka pemerintah melalui peraturannya mewajibkan perusahaan peternakan untuk melakukan kemitraan dengan petani ternak ayam ras. Peraturan kemitraan ini selain menjadi landasan hukum dalam melakukan kerjasama usaha, juga melindungi petani ternak, hanya saja dalam implementasi dan aplikasinya masih menghadapi beberapa permasalahan untuk dapat berhasil balk. Dari hasil penelitian menunjukkan bahwa faktor penyebabnya antara lain posisi plasma (petani ternak) yang masih lemah, adanya dominasi inti (perusahan peternakan) terhadap plasma, disamping itu peran pemerintah dalam hal ini Dinas Peternakan Kota Semarang masih minim sekali. Hal ini semua mengakibatkan kurang terlindunginya plasma baik dalam perjanjian kemitraan, dalam pelaksanaan perjanjian, maupun dalam penyelesaian sengketa. Kesemuanya itu terjadi dalam tahap pra produksi, proses produksi, dan pasca produksi, sebagai akibatnya plasma mendapatkan perlakuan yang tidak adil baik dalam penetapan harga, sanksi maupun resiko. Ditinjau dari hukum perjanjian, kedudukan antara inti dan plasma tidak seimbang, dimana inti lebih kuat dibanding plasma, sedangkan hubungan hukum yang terjadi dapat dikategorikan sebagai hubungan jual bell secara khusus, kekhususan itu terletalc pada : (1) syarat, (2) peralihan kedudulcan hukum, (3) peralihan halt mink. Dengan demikian dapat ciisimpulkan bahwa kurangnya perlindungan hukum terhadap plasma dapat diatasi dengan peningkatan kesetaraan diantara pelaku kemitraan dan peningkatan peran pemerintah.
