Abstract

Era global world telah dirasakan dan semakin cepat unifikasi dari negara-negara ataupun kelompok MNC dengan MNC lainnya. Penetrasi damai globalisasi melalui perdagangan mempercepat proses interaksi antar individu maupun kolektif. Efisiensi dan efektivitas adalah asas utama yang digunakan dalam perdagangan global tersebut, sehingga usaha rnanusia untuk menembus batas kecepatan waktu dan luasnya ruang menjadi orientasi perkembangan teknologi pendukung. Telekomunikasi adalah media 'yang memungkinkan harapan tersebut tercapai. Internet sebagai sebuah Spaceway dalam media Cyberspace sebuah ruang maya dimana waktu, ruang dan kecepatan yang menjadi faktor utama untuk parameter efisiensi dan efektivitas sebuah perdagangan balk Business to Business (B-B) atau Business ke Consumen (B-C) Berbagai permasalan hukum muncul akibat aktivitas dagang tersebut, hukum yang ada (positif) kiranya secara textime maupun konstitusional kurang mampu merespon interaksi sosial. Dalam penelitian yang berbentuk legal texbook baik hasil penelitian, artikel, mailinglist dan lain sebagainnya . Ternyata belum secara konkrit mengatur aktifitas ini sehingga perlu digunakan metode inteprestasi hukum dan analogi terhadap pasal/ pandangan positif dengan aturan maupun Regulasi tentang E. Commerce yang secara akumulatif telah digunakan di banyak negara di dunia. Ditinjau dari perdagangan sebagai wujud sebuah kesepakatan antara paa pihak berasas konsesualitas yang terdapat dalam KUH Perdata, KUHD dan KUHA Perdata maka dimungkinkan untuk menganalogi serta menginterprestasi tentang asas—asas norma kaidah-kaidah hukum konstitusional dalam aspek keperdataan dagang. Paradikma tentang positivisme hukum untuk sementara dirubah dengan 1 paradikma analogi dan interprestasi dapat diwujudkan dalam perundangan 1 nasional yang aplikabel terhadap aktivitas E.commerce yang tidak terjadi didepan mata kita. The global world age is occur and its acceleration process go faster and faster, through global peace penetration known as trade, which accelerate both individual and collective interaction processes. There is unification among countries and corporate groups, especially, between one-multi nations corporate (MNC) with another MNC. Efficiency and effectively is the main fundamental used by those global trade, so man's effort as businessperson is to predominate the limit of space and time, which followed by the growth of technology. Communication technology and infrastructure is selected, because of its function and capability to appreciate with a cyber space, which used by economic global person to make their dreams come true. Internet is a spaceway in cyberspace, which space, time, and speed become an ultimate factor for trade efficiency and effectiveness, both "business to business (B-B)" or 'business to consumer (B-C)" trade. Those trade activities emerges some legal problems. Indonesian positive legal, both textual and constitutional, not respond those problems yet, especially some forms and models of trade in global economic age. Form of this research is normative research that study any forms of legal textbook that is jurisprudence, regulation, research, article, mailing list, and form of contract of trade through electronic commerce. There is no positive legal, regulation, or ratification has ordered these activities concretely and only some sections in UU No. VI11/1998 and UU No. /1999 that talk about telecommunication is related partially. Data is analyzed qualitatively; both positive case and legal document and foreign act that occur in recent; then compared with interpretation method and legal analogy towards sections of positive act, regulation, and e-commerce documents which used by many countries. In observed trade as a deal among parties based by agreement that listed at KUH Perdata, KUHD and KUHA Perdata, may positivismparadigm changed to analogy and interpretation paradigm as analysis instrument 'towards principles, norms, rules, and legal constitutions. The next step is to drafted the concept textually, and finally realized in national act which applicable to all of e-commerce activities. Finally, electronic commerce has become preference for actual trade model; it is not just a dream or fiction. It is reality.
