Abstract
A bank is an enterprise having to do with service and finance. In carrying out its bussiness, a bank is supported by three sources of funds, they are the fund of the First Party, that of the Second Party, and that of the Third Party. The activities of a bank in collecting funds is closely related to the fund of the Third Party in the form of clearings, deposits, deposit certificates and savings. The funds that have been collected in the bank, are then distributed to people through credits. The difference between the interest of the credits and that of the people's savings will be the income of the bank. From the activities of collecting funds, the bank is doing its legal relationship with its customers having the fund/ creditors. The legal relation between the customers having the fund/ creditors, is in the from of agreement between a debtor and a creditors, and based on trust. In doing its legal relation, a bank is assumed to have a bargaining position. Therefore, a third party, which can protect the weak party, is needed. General protection can be seen from its suprasystem and system, which involves banks, customers having funds/ creditors and Bank Indonesia. Specific treatment can be seen from the subsystem, which is related to the management of the bank funds, and that of the bank bussiness. By means of proffesional bank management, the credibility of the bank can be improved so that customers having fund/ creditors will get profit. By having good management that is applying good moral and ethic of banking and being responsible for the bussiness, the bank activities and people trust to this enterprise can be increased. The success of the banking bussiness lies on the proffesionaliom of the bank management, as well as good and responsible banking implementation. Bank adalah badan usaha yang bergerak dalam bidang jasa dan keuangan. Dalam menjalankan kegiatan usaha, bank didukung dengan tiga sumber dana, yaitu dana pihak I, dana pihak II dan dana pihak III. Kegiatan bank dalam menghimpun dana berkaitan erat dengan dana pihak III, yang berbentuk giro, deposito, sertifikat deposito, dan tabungan. Dana yang telah terkumpul di bank, kemudian disalurkan melalui kredit. Dari selisih perolehan bunga kredit yang diterima, dengan bunga simpanan yang harus ditanggung, inilah yang menjadi pendapatan utama bank. Sedang jasa pelayanan merupakan pendapatan kedua, yang disusul dengan sumber pendapatan lain. Dari kegiatan usaha menghimpun dana tersebut, bank melakukan hubungan hukum dengan nasabah penyimpan dana/ kreditur. Hubungan hukum antara nasabah penyimpan dana/kreditur, berbentuk perjanjian antara debitur dengan kreditur, dan bersitat kepercayaan. Dalam melakukan hubungan hukum, bank diasumsikan memiliki bargaining position kuat, dibanding dengan nasabah penyimpan dana/kreditur. Oleh sebab itu diperlukan pihak ketiga, yang dapat melindungi kepentingan pihak yang lemah. Perlindungan secara umum, dapat dllihat dari supra sistem dan sistem, yang mehbatkan bank, nasabah penyimpan danaPerlindungan secara khusus dilihat dari sub sistem, yang dikaitkan dengan manajemen dana bank dan pengelolaan usaha bank. Dengan manajemen dana bank yang profesional, dapat meningkatkan probabilitas bank, sehingga mencapai keuntungan dapat dinikmati nasabah penyimpan danaikreditur. Dengan pengelolaan usaha yang jujur dalam arti berpegang pada moral dan etika perbankan, serta bertanggung jawab, akan dapat meningkatkan kepercyaan masyarakat terhadap kegiatan usaha bank. Kunci sukes kegiatan usaha bank, terletak pada profesionalisme manajemen bank dan pengelolaan usaha yang jujur serta bertanggung jawab. kreditur dan Bank Indonesia.
