IMPLEMENTASI KEBIJAKAN PELIMPAHAN SEBAGIAN KEWENANGAN PEMERINTAH DI BIDANG PERTANAHAN KEPADA PEMERINTAH KABUPATEN / KOTA (Studi Kasus di Pemerintah Kabupaten Semarang)

Abstract

The purpose of this research is to investigate and analyze the factors that influence the implementation of policies in the delivery of authority from Central Government to Regency Government dealing with the land affairs (Keppres No.34, Tahun 2003, Pasal 2 dan 3) in Semarang Regency Government. The research uses a qualitative method for the research methodology, The observation points on the phenomenon which refers to the implementation theory proposed by Edward III, which pervades the variabel of communication, resources, disposition or attitudes and the bureaucratic structure The data obtaining technique used in the research are, first : interview to the Semarang Regency Government Officials who are related to the policy implementations, and the related stake holders such as The B Commission of Assembly at municipal level (Komisi B DPRD), The Public Notary Organization (Ikatan PPAT Notaris), The Enterpreneur Association (Asosiasi Pengusaha Indonesia), and the public figures. The second is the documentation research related to Semarang Regency Government's policies. and The Land Affair Office. The data analyzing technique uses descriptive analysis. The research founds the deviations of the policy implementation such as; first, the policy not implementation for the reason of the limited resources of local government's resources. The second is the deviation of the policy implementations are affected by the factor of communication; that is the inconsistency of the orders or the commads about the policy. The factor of resources; that is the unavailability of qualitative and quantitative land affairs resources, the disposition factor; that is the attitudes which are not supporting and contradictory to the policy, and the bureaucratic structure; that is the fragmentations appear dealing with the sevices of regional land affairs. Tujuan dari penelitian adalah meneliti dan mengetahui faktor-faktor yang mempengaruhi implementasi kebijakan pelimpahan sebagian kewenangan Pemerintah Pusat di bidang pertanahan kepada Pemerintah Kabupaten/Kota (Keppres No.34 Tahun 2003, Pasal 2 dan 3) di Pemerintah Kabupaten Semarang. Metodologi penelitian yang digunakan adalah metode kualitatif, Fenomena yang diamati mengacu pada teori implementasi yang dikemukakan oleh Edward III meliputi fenomena Komunikasi, Sumber Daya, Disposisi/Sikap dan Struktur Birokrasi. Teknik pengumpulan data yang digunakan adalah, Pertama : wawancara mendalam kepada Pejabat Pemerintah Kabupaten Semarang dan Instansi Pertanahan yang berkaitan dengan implementasi kebijakan, serta stake holder terkait yaitu Komisi B DPRD, Ikatan PPAT Notaris, Asosiasi Pengusaha (AP1NDO) dan Tokoh Masyarakat. Kedua Penelitian dokumentasi yang berkaitan dengan kebijakan di Pemerintah Kabupaten Semarang dan Kantor Pertanahan, Teknik analisa data menggunakan diskriptif analitis. Hasil penelitian menemukan adanya penyimpangan dalam implementasi kebijakan, yaitu : Pertama, Kebijakan tidak dapat dilaksanakan oleh Pemerintah Kabupaten/Kota karena keterbatasan sumber daya pemerintah daerah. Kedua. Penyimpangan kebijakan dipengaruhi oleh faktor komunikasi yaitu inkonsisensi perintah kebijakan, faktor Sumber daya yaitu tidak tersedianya sumber daya pertanahan di daerah dari segi kauntitas dan kualitas, faktor Disposisi yaitu sikap tidak mendukung dan menentang terhadap perintah kebijakan, dan faktor Struktur Birokrasi yaitu timbulnya fragmentasi ban pelayanan pertanahan di daerah. Rekomendasi dari penelitian ini adalah perlu adanya perbaikan Keppres No. 34 Tahun 2003 khususnya pasal 2 dan 3, dan Surat Kepala BPN No. 110-1316 khususnya angka 3, dan kembali berpedoman pada UU No.22 Tahun 1999 dan UU No.25 Tahun 2000.
