Abstract

Electronic Funds Transfer merupakan pelayanan jasa bank dalam transfer dana, semula jasa bank dengan memakai warkat (transfer secara fisik) kemudian beralih dengan menggunakan teknik elektronik. Pada dasarnya transaksi dengan menggunakan Electronic Funds Transfer berbeda dengan transaksi pembayaran secara konvensional yang dilakukan dengan menggunakan kertas (paper) maka dalam Electronic Funds Transfer transaksi pembayaran dilakukan menggunakan media elektronik. yang mencakup transaksi Kartu Kredit, Automated Teller Machine (ATM) dan Transfer Dana. Dalam tesis ini diangkat tiga permasalahan, pertama bagaimanakah hubungan hukum antara bank sebagai pemberi jasa pelayanan Electronic Funds Transfer ( EFT ) khususnya pada Credit Card ( Kartu Kredit ) , Automated Teller Teller Machines ( ATM ) serta Transfer dana terhadap nasabahnya. Kedua factor — factor apakah yang menjadi kendala dalam perlindungan hukum konsumen terhadap nasabah pengguna jasa pelayanan Electronic Funds Transfer ( EFT ) khususnya pada Credit Card ( Kartu Kredit ) , Automated Teller Teller Machines ( ATM ) serta Transfer dana dan Ketiga bagaimanakah perlindungan hukum terhadap nasabah pengguna jasa pelayanan Electronic Funds Transfer ( EFT) khususnya pada Credit Card ( Kartu Kredit ) , Automated Teller Teller Machines ( ATM ) serta Transfer dana. Pembahasan terhadap hash penelitian dapat disimpulkan bahwa hubungan hukum antara bank sebagai pemberi jasa pelayanan Electronic Funds Transfer ( EFT) menimbulkan hak dan kewajiban , baik path hubungan hukum yadg terjthdi pada pelayanan kartu kredit, ATM maupun Transfer dana. Akan tetaPi dthngan telah terpenuhinya hak dan kewajiban nasabah, akan tetapi posithi nasabah tetap beradth dipihak yang lemah, hal ini disebabkin kthrena nasabah tunduk pada perjanjian baku, seperti yang diatur dated pasaI 1338 KUH Perdata. Faktor ythng merhthrlottruhi perlindungan terhadap nasabah penggund jasa ( EFT) dari hethil penelitian diketahui karena pengglinaa teknologi dan kurang berpihakhO lembaga yang terkai, walaupun Bank Indonesia dengan peraturan . Pbraturan Bank Indonesia No. 7 / 6 / PBI / 2005 Tentang Transparansi Inforinasi Produk Bank dan Penggunaan Data Pribadi Nasabah. Dan Peraturan Bank Indonesia (FBI) No. 7 / 7 / PBI / 2005 Tentang Penyelesaian Pengaduan Nasabah. Dengan tujuan memberikan perlindungan hukum nasabah dan menjamin hak-hal nasabah dalam hubungannya dengan bank serta mengatur penyelesaian pengaduan nasabah kepada bank Serta UU No 8 Tahun 1999 tentang Perrlindungan Konsumen. Solusi perlindungan hukum yang diberikan kepada nasabah dad hash penelitian di ketahui bahwa penyelesaiannya melalui Lembaga Mediasi. Electronic Funds Transfer is a bank service in the matter of fund transferring, which initially use the physical transferring that changed into electronic transferring. Basically, transaction by mean of electronic fund is different from conventional one using the paper. The Electronic Funds Transfer, the transaction of payment done by electronic media, covering Credit Card transaction, Automated Teller Machine (ATM) and fund transferring. This thesis rose three issues, first was how the relationship between bank as the provider of Electronic Fund Transfer (EFT) service especially on Credit Card, Automated Teller Machine (ATM) and fund transferring to its customers. Second is the factors that became obstacle on consumer law protection especially to credit card, Automated Teller Machine (ATM) and fund transferring. The third was about the matter of the legal protection on the consumers used this Electronic Fund Transfer (EFT) Service especially on credit card, Automated Teller Machine (ATM) and fund transferring. From the discussion of this research we can conclude that the relationship between the bank as the provider of Electronic Fund Transfer (EFT) service emerge the right and obligation, both on the legal relationship occurs on the credit card, ATM and fund transferring. But on the circumstances that the consumer's right and obligation had been fulfilled, the consumer still on the weak position. It was caused by the condition that the consumer must obey the fixed treaty, as regulated on the paragraph 1338 on KUH Perdata. The research revealed the factors influence the protection of the consumer using this EFT service is on the technological use and the less side of the regarding agency. Thought the regulation issued by Bank of Indonesia no. 7/ 6/ PBI/ 2005 about transparency of the bank's product information and the use of consumer's personal data, and the regulation no. 7/ 7/ PBI/ 2005 about the settlement of consumer complaining has the purpose of providing legal protection to the consumer and to ensure their right regarding the bank and regulating consumer complaining settlement against the bank. There was also the regulation no. 8 year. 1999 about consumers protection. It was revealed the solution regarding the legal protection to the consumer was on the mediation agency.
