FORMULASI DAN MEKANISME PENERBITAN KETERANGAN RENCANA KOTA (KRK) SEBAGAI DASAR PEMUNGUTAN RETRIBUSI PENGGANTIAN BIAYA CETAK PETA DI KOTA TEGAL

Abstract

Sejak diberlalatkan UU No. 24 tahun 1992 tentang penataan ruang yang berisi hak dan kewajiban Daerah Otonom dalam hat perencanaan, pemanfaalan dan pengendalian rata twang wilayah, maka daerah otonom bisa mempunyai kewenangan dalam penyelenggaraan sesuai peraturan yang berlaku. Rencana Tata Ruang Kota sebagai suatzt kebijakan yang mempunyai dasar hokum yang brat berupa peraturan daerah bersifat mengikat bagi selnruh warga di daerah tersebut sehingga hams ditaati dan dilaksanakan oleh selunth unsur pelaksana pembangunan / stakeholder. Salah salu ben/uk pengendalian Rencana Tata Ruang Kota adalah Keterangan Rencana Kota ( KRK ) yang meliputi pengendalian perencanaan tato ruang serta pelaksanaan bangunannya. Untuk di Kota Tegal , KRK dipakai sebagai salah sate acuan dalam pemberian perijinan yang meliputi !fin Mendirikan Bangunan (1MB), 1jin Gangguan, Ijin Lokasi, 1jin Sewa Tanah Pemerintah Kota. Permasalahan — permasalahan di Kola Tegal dalam pengendalian rencana rata twang antara lain adalah mekanisme KRK yang behtm jelas, meningkatnya pelanggaran akibat akiivitas perkotaan serta belum adanya retribusi penggantian biaya cetak pew. Dari permasalahan tersebut nzaka permasalahan yang penting adalah bagaimana formulasi dan mekanisme penerbitan KRK Sebagai Dasar Pernungulan Retribusi Penggantian Biaya Cetak Peta di Kota regal. Berdasarkan UU No. 22 tahun 1999, UU No. 25 tahun 1999, serta Peraturan Pemefintah (PP) No. 66 tahun 2001 tentang retribusi daerah, maka daerah otonom mempunyai otoriMs atas kelembagaatz, kebijakan dan keztangan daerah sesuai peraturan yang berlalat. Dalam peraturan tersebut, salah salu dari retribusi jasa umum adalah retribusi penggantian biaya cetak peta yang merupakan lampiran dari KRK, tetapi di kota Tegal peraturan retribusi tersebut behun ada sehingga belum bisa diberlakukan. Jumlah KRK yang sudah diterbilkan dari tahun 2000 - 2003 sebanyak 725 buah ,sedangkan selama lahun 2003 berjumlah 178 buah. Selama ini proses KRK melaliti Kantor Pelayanan Terpadu (KPT) yang koordinasi dengan instansi pengelola yaitu DinasPerkotaatz Kota Tegat Hasil penelitian yang berdasarkan data primer, data selcunder dolgan analisis latalitatif dan kuantitarif serta komparasi dengan kota Semarang dan kola Surakarta maka didapat has!! penelitian adalah fonnztlasi dan mekanisme penerbitan Keteranagn Rencana Kota (KM). Formulasi Retribusi penggantian biaya cetak peta yang mempakan lampiran dari KRK mempalcan fitngsi dari nilai ekonomis, zoning dan klas jalan, sedangkan nilai ekonomis , zoning dan klas jalan tergantung dari letak /anah yang diajukan KRK. Sedangkan mekanisme penerbitan KRK di Kota Tegal yang terpilih dari berbagai altematif adalah mekanisme model 1 yaitu proses permohonan KRK dimulai dan selesai di KPT, yang pada prosesnya KPT berkoordinasi dengan Dinas Perkotaan Kota Tegat Kesimpulan dalam penelitian ini adalah ditelapkan formulas? pemungutan retribusi pengganlian biaya cetak peta yang mempakan lampiran dari KRK yang dibagi dalam leas tanah > 300m2 serta leas tanah 300 m2. Selain int mekanisme penerbitan KI?K yang temilih adalah proses pelayatzan KRK dinzzdai dan selesai di KPT. Rekomendasi penelitian in% untuk Pemerintah Kota Tegal adalah mengusulkan agar segera dibuat peraturan daerah tentang penerbitan KRK beserta retribusi penggantian biaya cetak peta, serta mengharapkan agar segera direvisi togas pokok dan fiengsi (tztpoksz) pada KPT karma belum adanya pelayanan KRK di KPT Kota regal. Ever since the validity of UU No.24 / 1992 about the space order which consists of the rights and obligations of the Autonomous Region in planning, utilizing and regional space order controlling, therefore the Autonomous region is able to have the authority in the organization as the legitimate rules. Urban Space Order Plan as a policy has the strong law foundation in form of the regional rules, which is compulsory to all citizens in the country, thus it should be obeyed and conducted by all stakeholders or development performers. One of the controlling forms of the Urban Space Order Plan is the Urban Plan Explanation (KRK) consisted of space order planning control and also the performance of the development. For Tegal city, KRK is used as one of the reference in issuing license consisting Building Establishment Permit (IMB), Disturbance Permit, Location Permit, Municipality Land Rental Permit. The problems of Tegal city in the space order planning are such as KRK mechanism which is still unclear, the increased violations as the replacement / substitution of the map printing cost. From those problems, the most important problem is how the formulation and the mechanism of the KRK issuance as the foundation of the Retribution Collection and as the substitute of the Map Printing Cost in Tegal City. Based on UU No.22 / 1999, UU No.25 / 1999, and also PP No 66 / 2001 about regional retribution, therefore the autonomous region has authority over regional institutions, policies and finance as the legitimate rules. In those rules, one of the public service retributions is the retribution of map printing cost substitution which is the attachment of KRK. However, in Tegal city, retribution rule does not exist yet thus it hasn't been able to implement. The number of KRK issued from 2000-2003 is 725, while in the year 2003 is 178. During this period, KRK process is conducted through Integrated Service Bureau (KPT) coordinated with the organizing institution, Urban Service of Tegal Municipality. The research's result based on primary data, secondary data with Qualitative and Quantitative analyses and also the comparisons to Semarang & Surakarta Municipality, thus achieved the research result, which is the formulation & mechanism of the issuance of the Urban Plan Explanation (KRK). The Map Printing Cost Retribution Formulation which is the attachment of KRK is a faction of economic value, zoning and road class, whereas the economic value, zoning and road class depend on the land location proposed in KRK. While the KRK issuance mechanism hn Tegal Municipality chosen from various alternatives is the model I mechanism, which the KRK proposal process commenced and accomplished in KPT, in the process KPT coordinated with Tegal's Urban Service. The conclusion in this research is the establishment of the collecting formulation of map printing cost substitution which is the attachment of KRK divided in the size of land which is > 300 m2 and also the size of land which is 6 300 m2 .Besides, the KRK issuance mechanism chosen is the KRK service process commenced and accomplished in KPT. This research recommendation for Tegal Municipality is suggesting the urgency of the formulation of the regional policy concerning the KRK issuance along with the map printing cost substitution retribution, and also expecting that there is a revision on the main task and function of KPT because there hasn't been any service of KRK in KPT of7'0gal city
