TELAAH HUKUM PERJAMIAN TERAPEUTIK ANTARA PASIEN DENGAN DOKTER DI RUIVIAII SAKIT UMUM DALAM RANGKA PERLINDUNGAN KONSUMEN

Abstract

The importance of therapeutic agreement seen by law study point of view between the patient and the doctor in the hospital lies on the issue of law protection for the patients. Is is the patients who will bear all the medical acts when therapeutic agreement is not reachable. The patient may be get physical loss either becoming handicapped or dead as well as material loss. The study is focused on three problems, including : (1) How the law protection works on the patient in the therapeutic agreement between the patient dan the doctor in the hospital ? (2) What factors that result in the conflict between the patient dan the doctor in therapeutic egreement, how to prevent and to solve it ? (3) What attempts should we do for protecting the patient by law as medical service customers? The purposes of the study are to know the patient's law protection in therapeutic agreement between the patient and the doctor in the hospital ; to see what factors causing conflict between the patient dan the doctor in therapeutic agreement in the hospital, including its prevention and solution ; and to see the action that must do to protec patient lawfully as medical service customer. This study is applying normative juridical approach in order to find law in concreto and empirical juridical approach to see law protection in therapeutic agreement practice. The finding of the study indicates that : Firstly , the law protection for the patient in therapeutic agreement between patient and doctor in hospital has already adequately conducted well. The requirements of the therapeutic agreement between the patient dan the doctor in the hospital has been established by the hospital in kind of : hospital by laws, the hospital's director decree and the notification. Secondly, the factors that emerge conflict between the patient and the doctor in the hospital, are : lack of communication between the patient dan the doctor in the hospital, the patient do not understand what the essence of the therapeutic agreement is, medical treatment cost is very high, and the doctor having done malpractice, mistake and carelessness. The confict between the patient and the doctor can likely be overcame by making an agreement (reconciliation); The Honorary Council of Medical Ethic (MKEK IDI) ; The Disciple Council of Medical Labourer (MDTK) and Court of First Instance (PN). Thirdly, to give law protection for medical service customers, the government must fit out it with law control; the hospital should arrange and socialise hospital by laws ; the hospital should either socialise the exploit of the patient's rights ; and finally it should guide and control the performance of professional duty of hospital's human resources (SDM). Arti penting telaah hukum perjanjian terapeutik antara pasien dengan dokter di rumah sakit umum, terletak pada masalah perlindungan hukum bagi pasien. Tidak tercapainya tujuan perjanjian terapeutik, menempatkan pasien sebagai pihak yang haws menanggung segala akibat tindakan medis, baik berupa kerugian fisik yaitu pasien cacat atau meninggal dunia maupun kerugian materil. Studi ini difokuskan pada tiga masalah, yaitu : (1) Bagaimanakah perlindungan hukum bagi pasien dalam perjanjian terapeutik antara pasien dengan dokter di rumah sakit ? (2) Faktor-faktor apakah yang menjadi penyebab timbulnya konflik dalam perjanjian terapeutik antara pasien dengan dokter di rumah sakit, bagaimanakah upaya pencegahan dan penyelesaiannya ? (3) Upaya apakah yang hams dilakukan untuk memberikan perlindungan hukum bagi pasien sebagai konsumen jasa medis ? Tujuan studi yang ingin dicapai adalah ; mengetahui perlindungan hukum bagi pasien dalam perjanjian terapeutik antara pasien dengan dokter di rumah sakit; mengetahui faktor-faktor yang menjadi penyebab timbulnya konflik dalam perjanjian terapeutik antara pasien dengan dokter di rumah sakit, upaya pencegahan dan penyelesaiannya ; serta mengetahui upaya-upaya yang hams dilakukan untuk memberikan perlindungan hukum bagi pasien sebagai konsumen jasa medis. Penelitian menggunakan metode pendekatan yuridis normatif untuk menemukan hukum in concreto dan pendekatan yuridis empirik untuk mengetahui perlindungan pasien di dalam praktek perjanjian terapeutik. Temuan studi menunjukkan bahwa : Pertama, perlindungan hukum bagi pasien dalam perjanjian terapeutik dengan dokter di rumah sakit, sudah cukup memadai. Syarat-syarat perjanjian terapeutik antara pasien dengan dokter di rumah sakit telah ditetapkan oleh pihak rumah sakit dalam bentuk : peraturan rumah sakit (hospital by laws), surat keputusan direktur rumah sakit dan pengumuman direktur rumah sakit. Kedua, faktor-faktor penyebab timbulnya konflik antara pasien dengan dokter di rumah sakit, adalah : komunikasi yang kurang baik antara pasien dengan dokter, ketidaktahuan pasien mengenai hakekat perjanjian terapeutik, biaya perawatan kesehatan yang mahal serta dokter berbuat wanprestasi, kelalaian atau kesalahan. Penyelesaian konflik antara pasien dengan dokter di rumah sakit diselesaikan melalui musyawarah mufakat (perdamaian); Majelis Kehormatan Etik Kedokteran (IDI); Mejelis Disiplin Tenaga kesehatan (MDTK) dan Pengadilan Negeri (PN). Ketiga, untuk memberikan perlindungan hukum bagi konsumen jasa medis, pemerintah haws melakukan upaya melengkapi pengaturan hukum yang dibutuhkan bagi perlindungan pasien ; rumah sakit hams membuat dan sosialisasikan peraturan rumah sakit (hospital by laws) ; mensosialisasikan pemanfaatan hak-hak pasien ; serta melakukan upaya pembinaan dan pengawasan pelaksanaaan kewajiban profesional sumber daya manusia (SDM) rumah sakit.
