BEKERJANYA PERATURAN TENTANG PENEMPATAN TENAGA KERJA INDONESIA DI LUAR NEGERI DALAM HUBUNGANNYA DENGAN TENAGA KERJA ILEGAL (STUDI MENGENAI TENAGA KERJA ILEGAL DI DESA JAGO LOMBOK TENGAH)

Abstract

The Implementation of Rule of Indonesian Workers Settlement to the abroad in its relation with Illegal Workers (Illegal Workers Study at Jago Village of Central Lombok Regency). Illegal worker are the Indonesian workers settlement procedure to the abroad without using any document nor through legal procedure that have been established by the government in the Ministry of Labour Decree No. Rep/204/1999 regarding Indonesian Worker Settlement to the Abroad. The factors that make Indonesian workers going abroad are divided into general factors and particular factors. General factor is economic factor that becomes the dominant factor for Indonesian workers to going abroad through both legal and illegal ways. While the particular factor that arise the illegal workers is the society perception factor, bureaucracy factor, and the existing role of illegal agent that m otre dominant. The rule of law in the society of Jago village were influenced by three component, which are the legislation, culture of law component on Jago village society and justice maintainer official component. Influence of Indonesian workers to the abroad toward the economic development of Jago village can be considered from the remitten that send by the workers itself. The remitten have an important aspect especially in two matters. The first are positive consequence which appearance as the material consequences is the development of economic and trading activity in Jago village, while the second immaterial consequence is the exchange in social culture transformation and the increasing of aspiration and work motivation of the retired workers. Beside the positive consequence, there is also arise negative consequence which is the productive workers losing in the home region, awhich in this care are Jago village, particularly in agricultural sector. Finally, this condition caused the decrease in agricultural productivity level. Penelitian yang tertuang dalam tesis ini mengungkapkan hal-hal yang berkaitan dengan Bekerjanya Peraturan tentang Penempatan Tenaga Kerja Indonesia Ke Luar Negeri Dalam Hubungannya Dengan Tenaga Kerja Ilegal ( Studi Mengenai Tenaga Kerja Ilegal Di Desa Jago Kabupaten Lombok Tengah ). Tenaga kerja ilegal merupakan suatu prosedur penempatan tenaga kerja Indonesia ke luar negeri tanpa menggunakan dokumen apapun serta tidak melalui prosedur resmi yang telah ditetapkan oleh pemerintah dalam Keputusan Menteri Tenaga Kerja No.Kep. 204/KEP/ 1999 tentang Penempatan Tenaga Kerja Indonesia Ke Luar Negeri . Adapun timbulnya tenaga kerja Indonesia ke luar negeri disebabkan oleh faktor-faktor umum dan faktor-faktor khusus. Faktor umum adalah faktor ekonomi yang merupakan faktor dominan yang menyebabkan timbulnya tenaga kerja indonesia ke luar negeri baik legal maupun ilegal. Adapun faktor khusus adalah faktor yang menimbulkan tenaga kerja ilegal adalah faktor persepsi masyarakat, faktor birokrasi , dan peran tekong /calo yang begitu dominan. Proses bekerjanya hukum dalam masyarakat Desa Jago di pengaruhi oleh tiga komponen yaitu peraturan perundang-undangan , komponen budaya hukum masyarakat desa Jago serta komponen aparat Penegak hukum. Pengaruh tenaga kerja Indonesia ke luar negeri terhadap pertumbuhan ekonomi Desa Jago adalah dapat dilihat dari remitan yang dikirim olch tenaga kerja itu sendiri. Remitan memiliki aspek penting terutama dalam dua hal yaitu;pertama dampak positip berupa dampak material yaitu pertumbuhan ekonomu dan aktifitas perdagangan didesa Jago ,kedua dampak immaterial yaitu terjadinya perubahan¬perubahan dalam trasformasi sosial kulture dan terjadinya peningkatan aspirasi serta etos kerja etos kerja dari tenaga kerja puma tugas.Disamping dampak positip juga timbul dampak negatip yaitu hilangnya tenaga-tenaga kerja produktif di daerah asal dalam hal ini Desa Jago, khususnya di sektor pertanian. Keadaan ini pada akhirnya mengakibatkan menurunnya tingkat produktifitas pertanian
