KAJIAN TERHADAP PENJUALAN TANAH PUSAKA TINGGI DALAM PELAKSANAAN PEMBANGUNAN TERHADAP PERKEMBANGAN KAUM DI KELURAHAN GUNUNG PANGGILUN KACAMATAN PADANG UTARA

The purpose of this research is to know the ways and reasons Why customary law partnership sold their high inheritance land to the developer and the impact That would happen due to this sale. The using method in this research is socio-legal research and descriptive. In gathering the data, we get meeting paper document, history and another similar related in this researching object. A ft erward fro in I Ito result, known hat selling or giving away th c high inheritance land have a simple reason called "money", that is used for venture capital and left it up to the members instead, of bringing problem for the descendant in the next firture. The impact of Us selling is rapidly city development that caused rice field and dry field are changed become real estate or building and road. Meanwhile in other side, the members of the ownership is moved aside and forced to move from their own land. The reaction from the city government from this problem is so apprehensive and though the administration in West Sumatera is too late to anticipate. Demikian makin habis atau punahnya hada pusaka tinggi sehinmgga nialai nilai dari masyarakat adat yag sehelumnya hersifat lcomunal dengan solidaritas yang tinggi menjacli masyarakat yang bersifat individu. Metode pendekatan yang dipergunalcan Yuridis dan Sosiologis dengan mengambil lokasi di Kelurahan Quitting Panggilun Kecamatan Padang Utara. Adapun prosedur penjualan tanah harta pusaka tinggi mengacu kepada dtm sistitn hukun yakni : Menurut hukum Agratia dan peraturan pelaksanaan lainnya yang man asebeltun tanah tersehut dijual terlebih daludtt hams didaftarkan pada kantor BPN. Menurut hukum adat dengan kedudukan dan kowonangan mamak kepala kaum sebagai petnimpin kaum, maka di dalant sertifikat hanya yang di cantumkan nama mamak kcpala bum yang bcrtindak atas anggota bum, schingga dalam pcnjualamiya anggota kaum cukup mcmbcrikan persctujuan untuk menjual harta pusakanya. Dampak negatif hilangnya sendi Mau tali perekat balin anggota kaum itu sendiri yang dapat herpenpruh kpada tatanan social mayarakat persekutuan matrilineal yang bersifat kekeluargaan menuju inditddualislis. Karma dijualnya tanah pusaka, tidak tersedia lagi lahan untuk lokasi perumahan untuk anggota Icaum/generasi bum selanjutnya. ada lagi kehahanggan sehagai pendudulc asli Minangkabau karena tidak mempunyai tattah pusaka. Dengan itdanya bum yang matt menjual tanah pusakanya untuk dijadikan lokasi komplek perumahan, perkantoran dan canna lainnya dengan sendirinya secara tidak langstmg kaum telah dart membantu pemerintah di biding penthangtman pertunata /property.
