Abstract
Small and Medium Enterprise by UU No. 9 Tahun 1995 are two economic subjects together with publics organ which have some limitation and weaknesses. The law that is made has to able to protect the need and the importance of the Small and Medium Enterprise it self. The right of intellectual resources by UUM No.15 Tahun 2001, especially brand right has a big role in maintaining its products toguarantee law assurance as what happens with jenang Kudus home industry (as the research object). That fast and the furios of the recent technology development put the role of brands into important position, which have already appliedin the legislated rules, so that it showssome cases in the brand fields, such as Mubarok, jenang Kudus brand name which belongs to CV. Mubarokfood Cipta Delicia case against Mubarokah. Aside from the above cases, the writer also considers that it is needed to examine and to analyse further the matter about problems in registering brands especially for the Small and Medium Enterprise. The research method, is used in this study, is by using Juridical Empirical Approach, while the research location is in Kudus Regency, and the data collection technique is using the primer and secondary data. Research Result : it is summed that the Law Protection for the Small and Medium Enterprise through brand on the Mubarok branded jenang in Kudus Regency, has fulfilled the juridical requirements, although the punishment, which pronounced is much lower than the Legislation threats. Generally government regulation of the protection for the Small and Medium Enterprise through giving brand mechanism is not maximal yet. The barriers that are faced by the jenang Kudus home industry industrialies in their protection efforts for the Small and Medium Enterprise through brands is aroused because the Small and Medium Enterprise industrialies have not known and understood about the knowledge of brand, and also the economically and juridical advantages from the right registration on their products brands, the lack socialization about brand from the region government and from any other connected parties, and also company management pattern which is still very simple as the most significant factor so that the intensity in giving education and establishmernt on brands for the Small and Medium Enterprise is needed to be raised. Usaha Kecil dan Menengah (UKM) berdasarkan UU No. 9 Tahun 1995 adalah subyek ekonomi sekaligus organ masyarakat yang memiliki keterbatasan dan kelemahan. Hukum yang dibuat hams mampu melindungi kepentingan Usaha Kecil dan Menengah (UKM). Hak kekayaan intelektual khususnya hak merek (UUM No.15 tahun 2001) sangat besar peranannya dalam membantu Usaha Kecil dan Menengah (UKM), khususnya dalam mempertahankan produknya untuk lebih menjamin kepastian hukum, seperti yang terjadi pada home industri jenang Kudus (sebagai obyek penelitian). Pesatnya perkembangan teknologi mendudukan peran merek menjadi lebih penting, sehingga timbul persaingan-persaingan yang menjurus kepada pelanggaran-pelanggaran terhadap norma-norma/ kaidah-kaidah yang telah diterapkan dalam peraturan perundang-undangan, sehingga munculnya kasus-kasus di bidang merek seperti kasus Mubarok merek jenang Kudus milik CV. Mubarokfood Cipta Delicia melawan Mubarokah. Disamping kasus-kasus tersebut di atas penulis juga memandang perlu mengkaji dan menganalisa lebih jauh masalah mengenai kendala-kendala dalam pendaftaran merek terutama bagi Usaha Kecil dan Menengah. Metode penelitian yang digunakan melalui pendekatan yuridis empiris,lokasi penelitian di Kabupaten Kudus, dengan teknik pengumpulan data yang digunakan adalah data primer dan data sekunder. Hasil penelitian : bahwa Perlindungan hukum bagi Usaha Kecil Menengah (UKM) melalui merek pada kasus Jenang merek Mubarok di Kabupaten Kudus telah memenuhi syarat yuridis, walau hukuman yang dijatuhkan jauh lebih rendah dari ancaman Undang-Undang. Secara umum kebijakan pemerintah terhadap perlindungan usaha kecil menengah melalui mekanisme pemberian merek belum maksimal. Hambatan yang dihadapi para pengusaha home industri jenang Kudus dalam upaya perlindungan Usaha Kecil Menengah (UKM) melalui merek adalah disebabkan para pengusaha kecil menengah belum mengetahui dan memahami tentang merek, dan manfaat secara ekonomis dan yuridis dari pendaftaran hak atas mereknya produknya, kurangnya sosialisasi tentang merek dari pemerintah daerah dan berbagai pihak yang terkait serta pola manajemen perusahaan yang masih sangat sederhana, sebagai faktor penghambat yang utama, sehingga intensitas dalam penyuluhan dan pembinaan tentang merek bagi Usaha Kecil dan Menengah perlu ditingkatkan.
