PELAKSANAAN PERJANJIAN JUAL BELI TENAGA LISTRIK ANTARA PT. PLN ( PERSERO ) DENGAN PELANGGAN DALAM HAL TERJADI PERUBAHAN PEMILIK BANGUNAN / PERSIL STUDI KASUS PT. PLN ( PERSERO ) DISTRIBUSI JATENG - DIY AREA PELAYANAN DAN JARINGAN SEMARANG

Abstract

Parcel of land or lot where electric power connection is not always belongs to the property of lot, because in the developing of lot can be replace by the lot's property, permanantly or temporary. The effect of the the replacement of lot's right is the replacement of electric power connection from the old consumer to the new consumer, which has related in Article 12 draft Trade of Electric Agreement Letters ( SPJBTL ) which made by State Electricity Enterprise Co. Int Ltd for signing by the applicant costumer. But the Letters draft is not arrange yet in details about new costumer's right of lot's right, so that the research is needed to find out how the realization of SPJBTL by State Electricity Enterprise Co, Inc. Ltd in a term of lots's property replacement This research using the method of empirical juridical with the characteristic of analysis description which describe, explain, and reveal how the real implementation of electric power trade between State Electricity Enterprise Co, Inc. Ltd and costumer in concern with the replacement of lot's property. Especially how the State Electricity Enterprise Co. Inc. Ltd practises in distribution of Middle Java - Yogyakarta, branch Semarang. More over, the old costumer responsibility if there is replacement of lot's property is just when the replacement changes from the old costumer to the new one was reported by State Electricity Enterprise Co. Inc. Ltd and doing mutation. If there were new violation in the using of electric power by the costumer, then the old costumer should pay the delay payment of the new costumer or when it is too late to pay the bill of electricity, the State Electricity Enterprise Co. Inc. Ltd will cutting off the lot permanently or temporary, cancelling the electric power trade treaty and also become suspected if the new costumer robbing the electric power. To guarantee the law certainty in the implementation of Electric Power Trade Treaty, it is suggest that the right and obligation of costumers in a term of lot's replacement is arrange details with the widen of Article 12 draft SPJBTL between applicant costumer and State Electricity Enterprise Co. Inc. Ltd. So that, not only effective for the maker of lessor law, but also for all the law makers with the cause of the replacement of the lots's property. Kapling dimana sambungan tenaga listrik dipasang tidak selamanya menjadi pemilik kapling karena dalam perkembangannya kapling dapat dialihkan oleh pemilik kapling balk untuk jangka waktu permanent maupun jangka waktu tertentu dimana atas peralihan kapling tersebut turut beralih pula sarnbungan tenaga listrik oleh PT. PLN ( Persero ). Akibat terjadi peralihan hak atas kapling mengakibatican sambungaft tenaga listrik beralih dari pelanggan lama ke pelanggan barn, hal tersebut sudah dialcomodir dalam Pasal 12 draft Swat Perjanjian Jual Bell Tenaga Listrik ( SPJBTL ) yang dibuat oleh PT. PLN ( Persero ) untuk ditanda tangani oleh calon pelanggan, namun draft SPJBTL tersebut belum mengatur secara rind hak dan kewajiban pelanggan baru dengan PT. PLN ( Persero ) sebagai akibat terjadi peralihan hak atas kapling sehingga perlu dilakukan penelitian untuk mengetahui bagaimana pelaksanaan SPJBTL oleh PT. PLN ( Persero ) dalam hal terjadi peralihan pemilik kapling. Penelitian ini menggunakan metode penelitian yuridis empiris dan bersifat deslcriptif analitis yang alcan menggambarkan, memaparkan dan mengunglcapkan pelaksanaan perjanjian jual bell tenaga listrik antara PT. PLN ( Persero ) dengan pelanggan dalam hal terjadi perubahan pemilik kapling, khususnya sebagaimana dipraktekkan oleh PT. PLN ( Persero ) Distribusi Jateng - DIY Cabang Semarang. Dan i hasil penelitian diketahui bahwa pelaksanaan perjanjian jual beli antara PT. PLN ( Persero ) dapat berlangsung dengan pelanggan barn bila pelantean barn memenuhi kewajiban dan haknya sebagai pelanggan dan tidak melakukan pelanggaran dalam menggunakan tenaga listrik yang disalurkan oleh PT. PLN ( Persero ). Tanggung jawab pelanggan dalam hal terjadi perubahan pemilik kapling apabila perubahan pemilikan kapling tidak dilaporlcan pada PT. PLN ( Persero ) dan dilalcukan mutasi, tetap berada pada pelang,gan lama untuk membayar biaya keterlatnbatan apabila pelanggan barn tidak membayar atau terlambat membayar rekening tenaga listrik, dilakukan pemutusan sementara atau pemutusan rampung terhadap kapling, pembatalan perjanjian jual beli tenaga listrik serta menjadi, tersangka atau terdakwa bila pelanggan baru melakukan peneurian tenaga listrik. Untuk menjamin kepastian hukum dalam pelaksahaan pedanjian jual beli tenaga listrik, disarankan agar hak dan kewajiban pelanggan dalam hal twjadi perubahan kapling diatur secara lebih rind dengan memperluas bunyi Pasal 12 draft SPJBTL antara calon pelanggan clan PT. PLN ( Persero ) sehingga tidak hanya berlaku terhadap perbuatan hukwn sewa menyewa saja namun meliputi seluruh perbuatan hulcum yang mengakibatkan beralihnya hak milik atas kapling.
