Abstract

People interest on Toyota Avanza, a new model of Toyota is very high, because its price is economical. For that reason people are placing an advance order for Toyota Avanza at PT Nasmoco Kaligawe as a sole agent for Toyota in Semarang. The process known as "indent", advance money that will consider as installment payment of the car price after that car has been received by customer. Customers have to wait for several months to receive their ordered car, because of that time length some problems arise prior and after customers receiving their ordered car. Those problems are customer received unspecified car; customers received flawed car; delay in delivering ordered car; customer being outnumber by others in receiving their ordered car. There is a special case between customer as "indentor" with PT Nasmoco Kaligawe Semarang that is customer never received their ordered car, this case will be the main subject of this research This is an empirical legal research located PT Nasmoco Kaligawe Semarang. A descriptive analysis method is applied in this research showed PT Nasmoco's responsibility towards its client (customer / "indentor") if the car is not sufficient with its preliminary agreement. PT Nasmoco Kaligawe Semarang responsibility showed by giving an indemnification for injury sustained as compensation for customer and also set a punishment for any employee who create the damage. Tingginya animo masyarakat untuk memiliki mobil dengan harga terjangkau mengakibatkan Toyota Avanza yang belum diproduksi telah diindent konsumen melalui dealer resmi Toyota di Semarang yaitu PT. Nasmoco Kaligawe yang akan diperhitungkan sebagai harga mobil setelah mobil diterima konsumen. Disebabkan lamanya waktu penantian oleh indnetor mengakibatkan timbulnya masalah sebelum dan sesudah mobil sampai di tangan indentor antara lain mobil yang diterima indentor tidak sesuai dengan spesifikasi yang diinginkan indentor, mobil diterima dalam keadaan tidak sempurna, mobil diterima melewati batas waktu yang dijanjikan dan Mobil yang diterima tidak sesuai dengan nomor urut indentor serta mobil tidak diterima oleh indentor yang melahirkan masalah mengenai tanggungjawab perusahaan / PT. Nasmoco Kaligawe Semarang terhadap indentor yang menjadi studi dalam penelitian ini. Penelitian ini menggunakan metode yuridis empiris dan bersifat deskriptif analitis yang akan menggambarkan, memaparkan dan mengungkapkan bagaimana sesungguhnya tanggungjawab perusahaan / PT. Nasmoco Kaligawe Semarang terhadap indentor dalam hal mobil yang diserahlcan tidak sesuai dengan yang dipesan indentor. Berdasarkan hasil penelitian disimpulkan bahwa tanggung jawab perusahaan / PT. Nasmoco Kaligawe Semarang antara lain diwujudkan dengan memberikan ganti rugi terhadap konsumen atas tindakan karyawan Divisi Penjualan yang merugikan indentor dan memberikan sanksi terhadap karyawan yang mengakibatkan kerugian terhadap indentor.
