The research purposes were; wanted to know the cause factors why the parties did not attach the Price Ascension Clause in their contract related to Government Building Construction in Kendal Regency, also wanted to know the dispute settlement when the problem came up. The research done by using legal empirical approach. The data collected were primary and secondary data. The technique for collecting the primary data was interview; documentary stwly is done for collecting the secondary data. Based on the research result, in practice was known there were two types of contracts; contract which attached the Price Ascension Clause and contract which without attached Price Ascension Clause. The constructor did not attach the Price Ascension Clause in the contract because he did not want to be the blacklisted constructor because the parties did not predict yet about the price ascension. In practice, commonly the constructor have to be responsible when the price ascension happened which was caused by un official reason. In general, when Price Ascension problem came up, the parties would discuss for settling the problem, through; time lengthen, burden sharing for financial lose, building volume reduction, and price adjustment So the parties could adjust the content of the contract completely and fairly , the clauses, which have to attach, and the clauses, which have not to attach in the contract. The information dissemination about the contract law in general especially about Government Bui Wing Construction Contract have to be more often done by government.
