MEDIASI SEBAGAI SARANA UNTUK MENYELESAIKAN SENGKETA TANAH PERICEBUNAN PT. EST1J SUBUR DI ICABUPATEN BATANG

Abstract

The HGU Plantation land quarrel at PT. Estu Subur in Batang Region happened because the community is unwilling with the HGU prolongation of PT. Estu Subur that the license was over on 31 December 2000. Mean while the purpose of this research is to know the community consideration in proposing the objection of the project, to know the mediation process that is done, to know the FIGU land law status of PT. Estu Subur. In writing is thesis, the writer use the juridical empirical method, with descriptive qualitative research specification. The location of research is in Bawang Village and Pesantren Village Blado sub district at Batang region. The method of sampling is non-random sampling with purpose sampling method: the method of collecting data is library study and filed study. The analysis of writing thesis is using the data qualitative analysis. The community consideration in proposing the objection of the HGU extension project at PT. Estu Subur because, they have an opinion that HGU Land is their ancestor own, because today the economic condition is difficult, it makes the community ask the part of HGU Land to be used as the yard of house, residence and dry rice field for the community with land redistribution to the community. There are many of empty land, the management of PT. Estu Subur is un carrying with the community, the process of getting the land contain the elements of forcing, most of the HGU was expire date. The mediation process that is done by PT. Estu Subur to salve the quarrel - with the public of Bawang Village and Pesantren Village is by the meeting, problem information delivering and process of decision. HGU land status of PT. Estu Subur that was over the license an 31 December 2000 become the HGU ex land of PT. Estu Subur, it PT. Estu Subur was arranging the extension license of the land, but until the writing of this thesis, the certificate of the land still not print out yet. Sengketa tanah perkebunan HGU PT.Estu Subur di Kabupaten Batang terjadi karena masyarakat mengajukan keberatan dengan adanya perpanjangan HGU PT. Estu Subur yang telah bet-aid-Ur haknya pada tanggal 31 Desember 2000. Tujuan dari penelitian ini adalah untuk mengetahui pertimbangan masyarakat untuk mengajukan keberatan terhadap perpanjangan HGU PT. Estu Subur, untuk mengetahui proses mediasi yang dilakukan, untuk mengetahui status hukum tanah HGU PT. Estu Subur. Dalam penulisan tesis ini penulis menggunakan metode pendekatan yuridis empiris, dengan spesifikasi penelitian bersifat deskriptif kualitatif. Lokasi penelitian di Desa Bawang dan Desa Pesantren Kecamatan Blado Kabupaten Batang. Metode penentuan sampel menggunakan non random sampling dengan metode purposive sampling. Metode Pengumpulan data yang digunakan yaitu dengan studi kepustakaan dan studi lapangan. Analisa dalam penulisan tesis ini menggunakan analisa data kualitatif Pertimbangan masyarakat mengajukan keberatan atas perpanjangan HGU PT. Estu Subur karena masyarakat berpendapat bahwa tanah HGU tersebut milik nenek moyangnya, dengan semakin sulitnya perekonomian maka masyarakat meminta bagian-bagian dari tanah HGU tersebut untuk dipergunakan sebagai pekarangan, pemukiman, pertanian lahan kering dan tanaman keras tahunan bagi masyarakat dengan redistnhusi tanah kepada masyarakat, banyak dijumpai tanah-tanah yang belum dimanfaatkan / tanah kosong, pihak perusahaan perkebunan kurang memperhattlican lingkungan masyarakat sekitamya, perolehan tanah oleh perusahaan-perusahaan perkebunan tersebut mengandung unsur-unsur pemaksaan, sebagian besar HGU tersebut telah habis jangka waktunya. Proses mediasi yang dilakukan PT Estu Subur dalam menyelesailcan sengketa tanah perkebunan dengan masyarakat Desa Bawang dan desa Pesantren adalah diadakan pertemuan pars pihak, penyampaian informasi permasalahan, diadakan musyawarah dan pengambilan keputusan. Status tanah HGU PT. Estu Subur yang telah berakhir halcnya pada tanggal 31 Desember 2000 menjadi tanah Negara / tanah bekas HGU PT. Estu Subur, yang sudah dilakukan perpanjangan haknya oleh PT. Estu Subur tetapi sampai sekarang belum keluar sertipikat HGU atas nama PT. Estu Subur.
