Abstract

In a view of the, number and the importance of roles of rights on land in society's life, in order to lands have legal status; it is necessary to have a firm legal base. The giving of guarantee in legal security in lands needs written legal tools and effective land registration. Land certificate, which is a legal cause of registration of rights on land gives an important meaning and role in the rights ownership that can have function as proof of rights on land. Rights transfer through purchase and sale must be conducted before PPAT, because purchase and sale can only be registered if it is proven by minute made by PPAT. Therefore, a perfect process of land purchase and sale is by the presence of land certificate by the name of buyer so that can prevent conflict in the future. In this research, the methodology applied was juridical empiric approach. Data and legal material collection, both primary and secondary, were through observation, interview and legal document study related with the principle of matters. After obtaining the data, the data was processed and analyzed qualitatively. The implementation of certificate of rights on land because of purchase and sale in the Sub district of Western Semarang showed the high awareness degree of people in understanding the importance of certificate. The big amount of costs and the complicated process so that it took a long time, were reasons frequently emerged from people. It caused people was reluctant to do formalization with certificate. In this case, the roles of Land Office Officer are needed to eliminate the reluctance of people. It is necessary to have good approaches and cooperation between people and executor so that the difficulties they faced in proposing the making of certificate can be resolved together. Mengingat besar dan pentingnya peranan hak-hak atas tanah dalam kehidupan masyarakat, maka agar tanah mempunyai status hukum yang pasti, diperlukan adanya landasan hukum yang mantap. Pemberian jaminan kepastian hukum dibidang tanah memerlukan perangkat hukum tertulis dan penyelenggaraan pendaftaran tanah yang efektif. Sertipikat tanah yang merupakan akibat hukum dari pendaftaran hak atas tanah memberikan anti dan peranan penting dalam pemilikan hak yang bersangkutan, yang dapat berfungsi sebagai alat bukti hak atas tanah. Peralihan hak melalui jual bell harus dilakukan dihadapan PPAT, karena jual bell hanya dapat didaftar apabila dibuktikan dengan akta yang dibuat oleh PPAT. Oleh karena itu proses jual beli tanah yang sempurna bila telah diperolehnya sertipikat tanah atas nama pembeli sehingga dapat mencegah sengketa di kemudian hari. Dalam penelitian ini, metodologi yang digunakan adalah pendekatan yuridis empiris. Pengumpulan data dan bahan hukum, balk primer rnaupun sekunder melalui pengamatan, wawanc,ara dan studi dokumen-dokumen hukum yang berhubungan dengan pokok permasalahan. Setelah mendapat data yang diperlukan, data diolah dan dianalisis secara kualitatif. Peiaksanaan pensertipikatan hak atas tanah karena jual bell di Kecamatan Semarang Barat, menunjukkan tingkat kesadaran masyarakat akan anti pentingnya sertipikat sebenarnya sudah tinggi. Besarnya biaya dan prosesnya yang berbelit-belit sehingga membutuhkan waktu cukup lama merupakan alasan yang sering muncul dari masyarakat, hal ini menyebabkan masyarakat enggan melakukan pensertipikatan. Dalam hal ini peran petugas Kantor Pertanahan sangat dibutuhkan untuk menghapus rasa enggan dalam masyarakat. Perlu adanya pendekatan dan kerjasama yang baik antara masyarakat dengan aparat pelaksana sehingga kesulitan yang dihadapi dalam permohonan pembuatan sertipikat dapat diatasi bersama.
