Abstract
Hak Milik Atas Satuan Rumah Susun terdiri dari Satuan Rumah Susun yang dapat dikuasai secara individuil, Bagian Bersama, Benda Bersama dan Tanah Bersama yang merupakan satu kesatuan. Hak atas tanah bersama tunduk pada UUPA beserta Peraturan pelaksanaannya sedangkan Satuan Rumah Susun, Bagian Bersama, Benda Bersama karena bukan tanah semestinya berlalcu Buku II Kitab Undang-Undang Hukum Perdata tetapi berdasarkan Undang-Undang nomor 16 tahun 1985 diberlakukan Undang-Undang Pokok Agraria. Hak Milik Atas Satuan Rtunah Susun termasulc benda bulcan tanah tidak bergerak bertubuh dan terdaftar. Undang-Undang Riunah Susun mengatur pemilikan secara individual dan hak bersarna dengan nilai perbandingan proporsional, Pertelaan dan untuk Pengelolaan dilakulcan oleh Perhimpunan Penghuni yang diberi status sebagai Badan Hukum. Pada pralcteknya terjadi beberapa penyimpangan terhadap Undang-Undang Rumah Susun dan peraturan pelaksanaannya karena pada garis besamya Undang-Undang nomor 16 tahun 1985 dan Peraturan Pemerintah nomor 4 tahun 1988 tidak cocok untuk mengatur Rumah Susun bukan hunian. Ownership Right of a multi-level housing unit consist of a multi-level housing unit that can-be owned individially, as a "Clint share, a joint property and joint land that makes up an entity. 0 Joint land ownership obeys UUPA (Basic Agrarian Law) and its realization regulation, while a multi-level housing unit, a joint share, and a joint property, as they cannot be regarded as land, should actually obey Book II of KUH Perdata (Civil Law Book), but based on Law Number 16 Year 1985 they should obey the application of UUPA (basic Agrarian Law). Ownwership of a multi-level housing unit includes non-land assets that are non- movable, tangible and registered. The law of multi-level housing rules the ownership as individual as well as joint ownership with proporsional ratio value, Specification and Management are done by the Tenant Association that has been granted a Legal Body status. In practice some deviations of the multi-level housing law and its realization regulation have take place, because in general Law Number 16 Year 1985 and Government Regulation Number 4 Year 1988 are not suitable for the ruling of non-tenant multi-level housing.
