KONFLIK YANG MENYANGKUT TANAH ADAT SETELAH JAMAN REFORMASI (Studi Kasus Di Desa Culik Kec. Abang Kab. Karangasem, Bali)

Abstract

Bali, whose tradition (adat) law is still influencing very tightly and perceived by its law area, relies on cultural life and is largely influenced by religious components. Therefore, tradition law and religious exist equally and fill up each other, moreover the Balinese society is the Hindu followers. The entrance of the religious components into tradition law is obviously visible from the way of sentencing tradition punishment (sanction), which mostly concern with religious rites. In a line with economic increase both quantitatively or qualitatively, a dispute concerning with land in Bali recently increases its volume. On the other hands, the dispute of the land showing up is not loosely from the population which in national extent is sufficiently high and the needs of the land is crucial whether for housing, industry, agriculture, business area and so on. It results in increasing the land cost. By the increasing of the land cost, the society competes obtaining the land both in the appropriate ways in accordance with the existing procedures or in data manipulation. Thus, a conflict about the land whether those who belong to the tradition or the private might show up. The factors bringing about the conflict in Balinese tradition, particularly in Culik Village, Abang, Karangasem District, Bali are: Less awareness among the members named Dadia I Gede Badung and the members in Adat Culik, to solve the conflict with totally agreement, and the both sides insist on preserving their rights.The both sides concerning the ownership verification is valid, that is the members named Dadia I Gede Badung possesses the evidence of ownership right certificate.An economic factor, since the area is a tourist destination area, the cost of the land is increasingly high.Suspiciousness factors of whether the solution of the conflict tends to be advantaging for one of the sides. The judicial attempts conducted by the village officers Adat Culik and also government officers were assumed to be profitable for one side since the conflict occurred between a member of the tradition village and his Tradition Village and the attempts were believed to be beneficial one side. Until recently, the government officers had not taken optimal actions so that the sides took the decision to bring the case to the court or judicial procedure. Bali sebagai daerah yang hukum adatnya masih berpengaruh sangat kuat dan dapat diterima oleh masyarakat Bali, yang kesemuanya berpangkal pada hidup budaya dan banyak dipengaruhi oleh unsur-unsur religius. Oleh karena itu, hulcurn adat di Bali hidup secara berdampingan dan sating mengisi dengan agama, yang dimana masyarakat Bali agamanya mayoritas agama Hindu. Secara konlcrit terlihat dari tata cara penjatuhan sanlcsi adat, yang lebih banyak dikaitkan dengan ritual-ritual keagamaan. Permasalahan yang menyangkut dengan tanah di Bali akhir-akhir ini meningkat volumenya, sejalan dengan peningkatan perekonomian baik secara Imantitatif maupun secara lcualitatif, dilain pihak permasalahan tanah yang timbul tidak lepas dari penduduk yang secara nasional meningkat cukup tinggi dan kebutuhan akan tanah sangat penting sekali baik itu digunakan untuk perumahan, industri, pertanian, tempat bisnis dan lain sebagainya, dengan kondisi ini membawa akibat meningkatnya harga tanah. Dengan meningkatnya harga tanah tersebut masyarakat berlomba- lomba ingin memiliki tanah baik kepemilikannya sesuai dengan presedur ada juga dengan cara manipulasi data, dengan demikian akan timbul konflik tentang tanah baik itu tanah hak milik adat maupun tanah hak milik perorangan. Faktor-faktor yang menyebabkan terjadinya konflik tanah adat di Bali Khususnya di desa Culik Kecamatan Abang kabupaten Karangasem Bali karena; Kurang adanya kesadaran antara warga dadia I Gede Badung dan desa Adat Culik, untuk menyelesaikan konflik tersebut secara musyawarah mufakat, dan kedua belah pihak sama ngotot mempertahankan haknya, Kedua belah pihalc menganggap bulcti kepemilikarmya kuat, yaitu warga Dadia I Gede Badung memiliki bulcti sertifikat hak milik, sedangkan warga desa Adat Culik memiliki bukti pemunder (wasiat), Falctor Ekonomis, disebabkan didaerah tersebut adalah lokasi parivvisata sehingga harga tanah cukup tinggi, Fraktor axianya saling curiga apabila dalam penyelesaian konflik tersebut memihak salah satu pihak. Upaya-upaya hukum yang dilakukan oleh aparat desa adat Culik dan juga aparat pemerintah, karena konflik ini terjadi antara warga desa adat dengan Desa Adatnya, maka apabila diselesaikan oleh aparat desa Adat dari pihak warga Desa Adat menganggap putusan tersebut memihak Desa Adat, karena sampai mat ini aparat pemerintah juga belum mengambil tindakan- tindakan yang maksimal sehingga para pihak mengambil keputusan untuk mengajukan di pengadilan atau melalui jalur hukum
