Abstract

Kasus yang bermula dari dibukanya suatu L/C (Letter of Credit) oleh pihak importir Lady Bay yang berkeduditkan di Inggris telah membawa bencana bagi eksportir Asia Jati Furniture yang berkedudukan di Jepara Indonesia yang notabene adalah milik penulis Peristiwa ini telah membuka mata bagi penulis bahwa "Letter of Credit" sebagai salah satu sarana yang banyak dipakai dalam memperlancar transaksi perdagangan belmnlab antan sepentilinya melainkan eksportir hams ekstra hati-hatibila tidak matt ada permasalahan dikenvudian han dan perlu mempelajari secara mendalam oleh semna yang terlibat dalam perd.agangin internasional. 13erkenaan dengan itu, pendalam an pengetaltuan ten tang "Letter Credit' sangat diperlukan oleh pan eksportix, inwards d.an terutama oleh para eksektitif perbankan yang berhubungan dengan lain lintas pembayaran in ternasional. Semakin ahli den terlatilt pan eksportir dalam menyiapkan masing-masing dokumen pengapalan, semakin !nada pula bagi pan pejabat perbankan dalam melakukan penelitian dan pemeriksaan dokumen pengapalan. Hal ini dengan sendirinya akan sang-at mempertinggi efisiensi pengelolaan d.okumen di bank devisa. Proses it akan sangat memperlancar lalulintas barang clan penyelesaian pembayaran dalam bisnis ekspor impor pada umumnya. Dalam era globalisasi kelak, penulis berkeyakinan baltwa peranan "Letter of Credit" sebagai sarana pembayaran internasional, bukannya akan betkurang, malah Akin memegang peran an yang sanga t pen ting. Hal inilah yang men dorong penulis menyusun thesis deng-anjudul "PERLINDUNGAN 1-I UK UM TERRA DAP EKSPORTIR DALANI PERJANJIAN KERIA DENGAN L/C (LEI 1 ER OF CREDIT') SEBAGAT ALA T PEMBAYARAN11 "THE SHELTER OF LAW TOWARD THE EXPORTIR IN THE JOB AGREEMENT WITH THE LETTER OF CREDIT (L/C) AS A PAYMENT" By Fatoni Hadiyanto, SH The general banks in Indonesia as L/C's first performer do not have the similarity on the L/C transaction yet. This different opinion can be proved by a lot of questions from general banks to the Indonesia bank about the same problems of L/C. the different opinion also can be proved based on the debates, in the forum between general banks and indonesian banks, about the L/C problems faced by general banks. If the general banks act like that, how the other performers of L/C, like the applicant and beneficiary, must act. From the exporter and importer's angle of vision interest, the most prosecute and excellent payment system, is what they called "Letter of Credit". "Letter of Credit" is the way offered by the Foreign Exchange banks, in the settling of transaction payment for the international business. The export import business also called as document business or share business, because the realization of the transaction generally, is represented by shipping documents, such as "Bill of Lading", Trade Invoice, Draft, Insurance Policy and the others. "Letter of Credit" as one of the documents, has a good position as means of compiler for other shipping documents. So that, "Letter of Credit" also function as a means for research, investigation, and as a completeness of a shipping documents. Even after even that inflicted the local businessman in Indonesia had showed that "Letter of Credit" as a means of transaction payment was not absolutely safe. According to that situation the more experience about the "Letter of Credit" is very important for the exporter, importer and especially for the bank's executives who has relationship with the international payment traffic
