PENETAPAN HARGA JUAL TENAGA LISTRIK ANTARA PLN (PENGUSAHA KETENAGALISTRIKAN) DENGAN PELANGGAN

Abstract

PT. PLN is a government undertaking (BUMN) in a shareholder form in the field of electrical service, the rights of PLN in the filed of electricity seems to be monopolistic, so that it influences the price bargaining power of the consumer, in this case is the society. The government domination in the PLN's structure as a government undertaking (BUMN) in a shareholder form should be as a majority stock holder rather than as a general policy maker including in the determination of the selling price of the electric power... PLN as a shareholder has the authority to manage the company, because as a shareholder, PLN has its own board of directors, property separated from the government facilities, so in the position of the determination of the selling price of the electric power in naturally becomes the part of decision of PLN's board of directors which also represent the government and not becomes the government's decision like what happens so far. The relationship of PLN which rules the electrical power market in a monopolistic way is contradictory with the good condition of market, monopoly in the electrical industry makes PLN never places the customer (the society) in a ,good bargaining power during the selling price determination. The agreement of electrical service trading between PLN and the society should pay a good attention to the trading agreement appointments in general, including an agreement between the seller and the buyer in determining the selling price which formed independently without any compulsions-without any independence and an agreed price, the trade is considered as never existed. The explanation above is the condition that should be happened in the determination of the selling price of the electrical power mechanism between PLN as the electrical power industrialist and the customer. PT. PLN adalah Badan Usaha Milik Negara (BUMN) berbentuk Persero yang bergerak dibidang jasa ketenagalistrikan, hak pengolahan usaha bidang kelistrikan oleh PLN terkesan monopolistik, sehingga mempengaruhi posisi tawar menawar harga pihak konsumen yang dalam hal ini adalah masyarakat. Dominasi Pemerintah dalam strulctural PLN sebagai BUMN berbentuk Persero harusnya sebatas sebagai pemegang saham mayoritas dan bukan sebagai penentu kebijakan mutlak termasuk penetapan harga jual tenaga listrik. PT 1N sebagai Persero memiliki otoritas mengatur perusahaannya, karena PLN sebagai Persero memiliki Dewan Direksi sendiri, kekayaan sendiri yang terpisah dari fasilitas Pemerintah, sehingga semestinyalah dalam posisi penentuan harga jual tenaga listrik menjadi bagian dari keputusan Dewan Direksi Persero PLN yang juga mewakili Pemerintah dan bukan menjadi keputusan Pemerintah seperti yang selama ini terjadi. Hubungan PLN yang menguasai pasar tenaga kelistrikan secara monopoli sangat bertentangan dengan kondisi pasar yang sehat, monopoli dalam usaha kelistrikan membuat PLN dalam menetapkan harga, tidak pernah menempatkan konsumen (masyarakat) pada posisi tawar yang layak. Perjanjian jual beli jasa ketenagalistrikan antara PLN dan masyarakat harusnya memperhatikan ketentuan perjanjian jual beli pada umumnya, termasuk ada kesepakatan antara pembeli dan penjual dalam penentuan harga juat bell yang terbentuk secara bebas tanpa pemaksaan, tanpa kebebasan dan kesepakatan harga, jual beli dianggap tidak pernah ada. Penjabaran di atm merupakan kondisi yang seharusnya teijadi pada mekanisme penetapan harga jual tenaga listrik antara PLN selaku pengusaha ketenagalistrikan dengan pelanggan.
